In today’s America, we the people are not supporting the fundamentals of our system of government. That would seem like the bare minimum for America to continue to exist. So let’s look at an issue of the day and see if it gives us any insight. How has court-packing become a serious discussion topic?
No, this is not a post about Emerson Lake and Palmers Karn Evil 9. (First Impression Part 2). Well, not exactly. And the exhibits are not exclusively our own, but it is the show that never ends. Politics. And, as it turns out, election season.
The Empire State’s Emperor, Andy Cuomo, claimed his order restricting the size of religious gatherings was neutral. “Cuomo told the justices, the order isn’t focused on gatherings because they are religious, but because of the possibility that they could be “superspreader” events.” The Court didn’t care.
When you make a federal case out of a state concern, you create a winner-take-all situation. If you think you’re going to win, that’s good, because you’ll win everywhere at once. But if the tide ever turns, it’s bad, because you lose everywhere at once.
Accusations fly back and forth between the political parties, each claiming the other is politicizing the United States Supreme Court. However, a brief look at the history of the Supreme Court establishes this is neither new nor novel.
Lisa Murkowski is a moderate Republican squish in the mold of John McCain. Murkowski didn’t try to overturn Trump’s election as did McCain, but they were otherwise aligned. As such, Murkowski cannot be counted on to help appoint a Trump SCOTUS nominee.
I am not closely following the chaos left in the wake of Justice Ginsberg’s passing. I don’t need to do that. Their formulae, tactics, and strategy are catalyzed by TDS, Trump Derangement Syndrome, and the possibility of losing a court-side legislative vehicle for decades to come.
