Please Keep Your Hands Off My Speech

Political speech is a popular subject these past few days, and seeing as that is what we do here, it should be.  Any slight change about what is defined as paid speech could make what we do very difficult to define financially, and more cumbersome to execute.  Take for example the value of web space or the cost of remote equipment used to broadcast “speech.”  If we are not cautious, these and many other things might become “expenses” for “Speech hobbyists,” like those at GraniteGrok, that would require us to register and file with the Secretary of State.  And failing to do so might invite action from the Attorney General.

So while the goal of speech related legislation may be to identify fly-by-night political groups who gang rape your constituents mail-boxes with lies and hate, the potential collateral damage is much too great.  People forget that lies and hate are protected by the first amendment.  We should have other laws for dealing with that (and not the lefts hate speech laws, a topic for a different post).   Any speech related legislation should not define, value, or in any way complicate the act of speech itself; when you meddle with political speech you always risk placing a gag on it and at the very least risk handing someone else the gag to be applied later.

The Reality of Progressive Intimidation

What you should take away from the Rush Limbaugh fracas, other than that aside from the choice of words, he was right.

First, advertisers who initially abandoned Rush Limbaugh are afraid of the left.  They are afraid that the party of big government will come at them with all their resources to undermine whatever it is they do.  So they cannot be trusted to stand up for free markets or capitalism.  Plain and simple.  They will never defend freedom of speech or the right of association.

Tyranny of the Pen – but in spinning, Obama’s Jack Lew leaves a glaring and obvious hole

Jack Lew used to be Obama’s Budget Director – well, given that the Democrat controlled Senate has now gone 1,100 days since passing a budget (as the law requires), methinks he has had little to do.  Now given that Daley didn’t make nice (or couldn’t) with Jarrett or Michelle, he was elevated to The One’s Chief of Staff and he made the rounds of all of the major Sunday talking head shows.  Pretty much, same speech, same words…

… and each and every time, Sherlock’s dog wasn’t barking.  Good thing he wasn’t testifying in court, as he would have been held in contempt for not “telling the whole truth”.  Just like Jeanne Shaheen, it is obvious that the values we hold dear and can plainly read in the Constitution are not those of Lew or Obama. In this, Lew is helping Obama to “…fundamentally transforming the United States of America” in arguing for Obama’s HHS rule to establish primacy of Government to determine what is a religious organization or not (and therefore, which falls under First Amendment protection or not).

He pretty much made the same argument using pretty much the same words on each and every one of the Sunday talking head shows.  The only one that tried to challenge him was Fox News Sunday (and even at that, I think that Chris Wallace did not have his finest game on tap).  It was obvious that Lew was spinning as fast as a windmill in a hurricane – and it was obvious as he tried to defend Obama’s “conciliatory” redo of the religious exemption of institutions being force to provide employees with contraception services (including sterilization, abortifacients, and abortion) and thus, violating their core theological tenets and morality.  Simply stated, he would not allow that this is a Government overreach into the heart of religious theology and governance – simply “why can’t you morons understand this is ‘for the women’ with our revised policy?”

He also has a very deep belief that it is one of our core principles of our country that we have to respect the religious liberties of this country is built on.  The solution we have reach is consistent with those core principles.”

Both President Obama (D-Chicago) and Senator Jeanne Shaheen (D-NH) have not problem in throwing the Constitution under the bus.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

That would be the First Amendment to the U.S. Constitution for the clueless (or graduates of the Government school system).  Alternative titles:

  • “Both President Obama and Senator Jeanne Shaheen both agree with only half of “The Bigger the Government, the smaller the citizen”.

Obvious, both of them believe that Government is not big enough!

Jeanne Shaheen Wicked WitchWe have certainly seen lately that Shaheen decided to shred the idea of Federalism when she used the force of The Feds to override the NH elected Executive Councilors in funding Planned Parenthood.  And now, it seems, she not only has joined and gone all in with Obama with his assault on religious Liberty (Liberty – you know, the foundational philosophy of our country in all things personal, economic, and religious?).  It seems that as well sneering at the five Republicans on the Exec Council (“Look at me, you puny people – *I* can use the force of Bigger Government to tell NH how it will be run!”), she’s also been in forefront of getting Obama to throw Catholics onto the tracks as the Progressive train runs the US away from the idea of individual Liberty to that vaunted goal of

we’re all in this together – whether or not you want to!

NRA – a very timid step, but are they finally getting the big picture??

NRA grassroots email alertsAs an former NRA member, I still get their NRA-ILA alerts and I am always figuring that this is the indication of what they are thinking concerning the “big” picture.  After all, a couple of years now when the Dems were pushing the DISCLOSE act that would have restricted Free Speech, the NRA was silent.  Absolutely silent – and that in and of itself created a fire storm from both conservative grassroots and from their own membership akin to “Are you guys flippin’ morons??  You CANNOT just concentrate on protecting just the Second Amendment (the right to bear arms) if they take away your First!”

The NRA kept saying that they were a one issue group (as if that was a sufficient), so that’s why they wouldn’t be speaking out on that issue.  Period – and in my mind, given what they could have brought to bear, a cop-out of the first degree.  That is also why I am an ex-NRA member, because unless you are willing to protect it all, you will lose your one issue.  A particular section of a wall cannot stand on its own and be effective if the rest of the wall has been knocked down by incoming enemy fire – and make no mistake, the entire founding philosophy of the Constitution is under heavy attack from Progressives. Yes, concentrate on your single issue, but there are times we all have to be voluntarily interlocked to protect the freedoms that are trying to be wrenched from us under the guise of the Marxist “greater good” collective group-think.  This is, again, one of those times.

Senator Jeanne Shaheen: Prioritizing political ideology on abortion over First Amendment Right of free expression of Religious Belief

It wasn’t until Jan. 20 that HHS Secretary Kathleen Sebelius announced the administration’s decision, sparking the firestorm from the bishops and the GOP presidential field.

“It’s very disturbing to me that his decision has been distorted and misinterpreted,” Shaheen told POLITICO. “It’s an issue of women’s health. Birth control is nearly universal in the country. I don’t understand why this is such a big issue.

No, you wouldn’t, nor does it seem, that you want to.  And not it is not an issue of women’s health.  It is all about a Progressive mindset that Government has can tell its citizens your religious beliefs are subordinate to our decrees.  It is all about Government telling its citizens that the Constitution does not matter on one of the issues that laid the foundation of our Country.  It is all about Government turning the relationship of American citizens to their Government.  It is all about losing the consent of the Governed…or actually, ignoring that it is a necessary component of American Exceptionalism, and making a crass political decision that beliefs of an unprotected minority are of no account.

NH Democrats Still Want To Limit Free Speech

What price for speech?In the waning days of New Hampshire’s leftist experiment of 2007-2010, in the months leading up to the crackling heat of the 2010 election, the Democrat-lead state legislature attempted to pass the Sullivan/Hassan speech intimidation amendment attached to NH HB1459 .

This kitchen-table Frankenstein was strung together by Democrat party Committee creature Kathy “Lawsuit” Sullivan and then Democrat state Senator Maggie “The Red” Hassan, from dead bits of left wing jack-booted policy dreams.  The goal was to quickly replace the gag that the Supreme Courts Citizens United v. FEC ruling had removed.  They would require businesses to get permission to engage in political speech if they intended to spend over a certain sum.

Assigning government regulated speech limitations based on some arbitrary, government defined value was hardly the worst of it. The democrats also wanted to empower third parties to intimidate political speech for them as well.  Anyone with the money and time could file a lawsuit against any business that it thought could have violated the law.  This would give every out of state funded left wing non-profit the ability to pay its left wing, democrat supporting lawyers, to cast a chilling anti-speech pall across the New Hampshire Landscape.   Fear of litigation would instantaneously exclude thousands of voices from the political debate simply because they could not risk the time and expense of being sued, even erroneously, should they fail to dot all the I’s and cross all the T’s.

From square one this was a partisan, prejudicial and intentionally unconstitutional act.

Government can do nothing without first denying someone of their legally earned income, so this bill established that it was acceptable for 51% of those doing the taxing to define what constituted free speech.  When that happens free speech is no longer a protected right, it is a legislated privilege regulated by a democratic mobocracy.  It no longer mattered that every business pays some kind of tax, in most cases dozens of them, to finance government. It did not matter that the right to free association can take the form of a business or group that might have an interest in it’s relationship to how government exercises power in their name.  All that mattered to New Hampshire Democrats was that free speech continues to be a barrier to their political success, and if they could silence any class of persons they could find a way to silence any dissenter they chose.

Ask yourself, which party is forever trying to limit free speech and the answer is Democrats?  The war on business, the fairness doctrine, the war on new media and Fox news.  The insults and slurs hurled at the TEA party.  These are all efforts to intimidate or limit speech to which the left objects.  They have no interest in fairness or equality of message.  They seek to control the message.

The New Hampshire Democrat effort to complicate, regulate, and even intimidate anyone out of having free reign to speak about how or how often they are taxed, about how those taxes are used, and to actually sanction random intimidation by entities outside the government, should have immediately disqualified them from every holding another elected office.  We came just a few votes shy of passing a bill that Governor Lynch said he was prepared to sign.

This is not something we can forget.  It defines the character of everyone who voted for it, sanctioned it, or supported it.  This thinking permeates everything about their grasp of your relationship to government.  They still think this way, and they will continue to argue in support of it, even though their actual justifications for it, are fatally flawed.

The Church Of Cheeseburgers And Fries

Does this come with Holy Wafers?There’s some dispute regarding appearance standards in which a young woman has insisted that her pierced nose is part of her religious beliefs.  Long story short–she does not want to remove the piercing on religious grounds because she is a member of the "Church of Body Modification." 

The Church of Body Modification espouses an open minded approach to what it calls ancient body modification rites that are essential to spirituality.  Funny, that’s what most ancient body modification cultures said to justify ritual human sacrifice.  You know, removing the heart, chopping off heads, that sort of thing.  Had to do it to appease the gods.  Millions ‘modified.’ 

And aren’t clitorectomies and ancient religious form of body modification?  I wonder if they are tolerant of those as well?  Stoning women is another winner–not so much spiritual, but a religiously motivated modification none the less.

Hodes Monkeys With The First Amendment

Right to What?Reading Paul Hodes blog at the daily KoS is the literary-equivalent of watching monkeys throw poo. What is perhaps more disgusting is that the KoS Kids roll in it like heather and serve it to each other as if it were pâté de foie gras , encouraging their own sheer ignorance as they dance nine times widdershins about the burning remnants of the US constitution.

This week’s poo fling comes after Chuck Schumer’s evil plot to water-board the first amendment failed to properly rise in the oven Schumer usually cooks his constitution in. He’d helped craft something called the DISCLOSE act, which disclosed to us just how brazen power hungry incumbents can be when their brazen power-hungriness gets the best of them. They write laws to silence the speech they don’t like while ignoring speech they do. So when the soufflé dropped after Paul Hodes already voted for it he did what any cry-baby liberal does. He grabbed his talking points and hid in the skirt of the moon-bat mother ship.
