Twenty-two months after announcing that the Guantanamo Bay detention facility would be closed in twelve months, the Obama administration has announced that they will now be holding Khalid Sheikh Mohammed at that facility, indefinitely, without any trial at all.
No word on how this will be viewed on the Muslim street or what affect it will have on terrorist recruitment but Obama’s advisers seem to think this is the safest solution to avoid pissing off more of their base. Military tribunals would be worse than indefinite detention without trial, or more importantly admitting error on civilian trials, or acknowledging that your entire party went on a rhetoric-bender on an issue you knew nothing about now that you are standing there naked, and politically flaccid.
But this is not as simple as calling out the liar in chief on another populist pander. What does this mean for the liberal assumption that combatants captured in foreign lands are entitled to the same constitutional rights as you or I? Does it have a shelf life like everything else or are they preparing to apply the new interpretation of ‘constitutional right’ domestically?
The next thing you know military trials will be their idea and Muslims will appreciate club Gitmo.
