Morning Update: Can’t Sue China

Today, on the Morning Update, climate cultists are spewing their emissions at the US Supreme Court, hoping for a big score against “big oil,” but if they truly want to “make a difference,” they should be suing China… but maybe they can’t.

Welcome to your Wednesday, October seventh, 2026, Morning Update.

Climate cultists recently got double-tapped in the state of New York, where the empire tried to make bank on false claims about fossil fuels. Not one but two federal judges shot down their massive cash grab, and that’s all it really was.

When you spend as much as democrats do, you have to steal it from wherever you can. And large companies, just like the rich, make juicy targets.

And while New York and all those other states have tried and failed, they could have gone after someone like, say, Big Pharma, who has obviously done some actual, real harm, beating up on oil companies serves another part of their agenda. It fulfills a checkbox in the progressive project’s purpose.

Milking them will make energy cost that much more.

Whatever they take from them actually ends up coming out of your pocket. They aren’t robbing them for you. They are robbing you for themselves. Big tobacco, big oil, big whatever, they’re just proxies. Proxies for a process meant to punish you. Higher costs, fewer jobs, more expensive everything.

And many of the same people have tried and failed to claim emission harms to fund their addiction to other people’s money. Boulder County, Colorado, got all the way to the US Supreme Court with their case, but a majority of justices are skeptical of the premise.

The attorney for Suncor, the energy company being sued by Boulder, Colorado, argued that the lawsuit represented an attempt to impose legislation by other means. He says this case and others like it reflect an all too regrettable trend of trying to resolve major political issues in court rather than leaving them to the political branches where they belong, he argued.

David Bookbinder, who previously served as part of Boulder’s legal team on this case, appeared to give weight to the argument. Tort liability is an indirect carbon tax, Bookbinder said on a Federalist Society panel in October 2025. You sue an oil company; an oil company is liable. The oil company then passes that liability on to the people who are buying its product. I’d prefer an actual carbon tax, but if we can’t get one of those, this is a rather somewhat convoluted way to achieve the goals of a carbon tax.

The goal of a carbon tax is to steal your money through a proxy, which they will then spend on whatever is important to them, when you should be left alone to spend it on whatever is important to you.

And that’s all this is. It’s legislation by judicial fiat. Another thing Democrats love as long as it goes their way.

Boulder County, Colorado, wants more money. They want your money. They can only rob you mostly blind, at least to your face, until you come knocking on their door. The same schemes have been tried in mostly blue cities, counties, and states. Including the law passed in New York I mentioned earlier.

One that is nearly identical to a law in Vermont, which is equally unconstitutional.

They all share something in common with the climate cult as a movement, and I mean that in the most intestinal way possible.

The majority of actual pollution on the globe, from plastic in the oceans to emissions from factories and fossil fuels, comes from places like India, Africa, and China. China mostly, but we don’t see anyone in the climate cult working to kneecap China’s industrial complexes or suing their companies.

And that’s where they could do the most good. You know, for the planet.

The same holds true for these kinds of lawsuits. You should go to China and tell them to stop emitting all this crap into our shared biosphere. And while you’re there, since you claim to care so much about people. Lots of human rights violations.

Or is that a stipulation of the NDA arrangement between the climate cult, its NGOs, and its paid-for politicians? Because China paid you to trip America so China could get ahead, you aren’t allowed to sue them for being the largest single polluter and emitter on planet Earth.

In exchange, you keep getting more money to make trouble for America and Americans, and they let you keep your organs.
