Vermonters will have the opportunity to enshrine two stupid ideas into their constitution this November. Both are Bad Ideas, and to my mind do exactly the opposite of what they claim or intend.

Welcome to your Friday, July 31st, 2026, morning update.
The title of today’s morning update is Vermont Dumb. To be clear, there are lots of smart people in Vermont. Vermont is a beautiful state with a fabulous history, at least until the Democrats got their claws into it. It’s a lovely place. However, they’ve been doing some really dumb things lately.
This year they have two proposals to amend the Constitution, both of which, in my opinion, do exactly the opposite of what they intend.
The first one, right to collectively bargain, that employees have a right to organize or join labor organizations for the purpose of collectively bargaining with their employer through an exclusive representative of their choosing for the purpose of negotiating wages, hours, and working conditions and to protect their economic welfare and safety in the workplace. Therefore, no law shall be adopted that interferes with, negates, or diminishes the right of employees to collectively bargain with respect to wages, hours, and other terms and conditions of employment and workplace safety, or that prohibits the application or execution of an agreement between an employer or a labor organization representing the employer’s employees that requires membership in the labor organization as a condition of employment.
This is being sold as a workers’ rights constitutional amendment. It is exactly the opposite. Once instituted, if a union wants to organize at your workplace and succeeds, you have no choice. You either have to pay dues, or you quit.
The other problem, and I like this one even better. This is proposal four. Equality of rights. Right out of the gate, we already have them (rights). We all have them. They’re all the same. They’re enshrined in the national constitution. They’re enshrined in state constitutions.
Proposal four. That the people are guaranteed equal protection under the law. They already are. We don’t need the amendment. The state shall not deny equal treatment under the law on account of a person’s race, ethnicity, sex, religion, disability, sexual orientation, gender identity, gender expression, or national origin. They already can’t do that. You don’t need any of those words. Nothing in this article shall be interpreted or applied to prevent the adoption or implementation of measures intended to provide a quality of treatment and opportunity for members of groups that have historically been subject to discrimination.
You just contradicted proposal four. If everybody is equal under the law, you cannot make laws that carve out anything for anyone. On any terms. You’re basically saying no law shall be made that results in inequality, except for these laws, which we will propose for these individuals in the name of equality.
You can’t say that we’re all equal under the law, and then say we need to make laws to make some people more equal than others.
