I got an email from a friend of mine reminding me that there are a few Second Amendment bills that are coming up on Tuesday for “Executive Session” (meaning the Committee will vote them Ought to Pass or Inexpedient to Legislate (send to the whole House or kill it now). They’ve been sitting on the “legislative shelf” and finally are coming due. The Senators have been stalling on these important self-defense bills since spring & are tight-lipped about their thoughts. Anyone is welcome to attend the vote, but may not be able to speak. 1:30pm Room 103 State House.
- HB440 – (Jim Kofalt, prime sponsor, already published on GG): prohibits the suspension of civil liberties during a state of emergency. Put it another way – the Constitution cannot be trumped by an “emergency”.
- HB196 – showing a gun to warn someone criminally trespassing on your property will not be considered a criminal act
- HB197 – permits the use of deadly force against another person in circumstance where deadly force is used in the commission of felony against a person in a vehicle. Like if your car ends up in a riot area (like we saw during the summer Antifa / Black Live Matter riots) and they start attacking your car.
And then there is HB307 (Prime Sponsor is one of my Reps, Norm Silber) which makes illegal any attempts by local subdivisions of the State (e.g., Counties, Cities, Towns, School Boards, et al) who illegally attempt to infringe on the Second Amendment and Article 2-A Rights to keep and bear arms in subverting the State’s Laws (we are NOT a Home Rule state and it is illegal to enact local ordinances or policies contrary to State law.
