Biden’s “Packed” Court Commission Can’t Justify Packing the Court

Remember that time at Presidential Election Camp, when Democrats wanted to pack the Supreme Court? F Joe Biden or someone operating in his name even appointed a commission to make it look like a great idea. Not so great.

It failed to come to the desired conclusion.

The “commission” was formed for one purpose. Their job was to create a huge report upon which creepy Joe to stand. It would give him and the media a better view of the court he intended to pack. Add a few lefty-judges. That would fix their wagon and derail America. Not that the latter is not well underway by other means.

All he needed was cover.

They failed to deliver it.

The Commission did produce a report but it was inconclusive.

As we noted at the outset of this there is profound disagreement among Commissioners over whether adding Justices to the Supreme Court at this moment in time would be wise . As a Commission we have endeavored to articulate the contours of that debate as best as we understand them, without purporting to judge the weight of any of the arguments offered in favor or against calls to increase the size of the Court.

It had a lot to say but that’s not what Biden or whoever is running that Administration needs. The media can’t flood the zone with “inconclusive.”

In other words, the past nine months have been wasted. Well, not totally. The commission took up space and produced a report but one that is smaller than the average bill in Congress.

It’s not even the size of a small phonebook.

But never fear. As Law rof. William Jacobson notes, “If SCOTUS overturns Roe v. Wade in the Mississippi abortion case, well, the screams could become, ahem, an insurrection.”
