GIVE ME A BREAK. Employers have NOT had a “right … to determine what level of risk is acceptable within that property” since the end of the 19th century. Either Josiah Bartlett is living in an alternative reality where there is no OSHA … or Josiah Bartlett is gaslighting us. I’ll go with the latter. And, by the way, while I do believe that regulation can and often does go too far … workplace death and serious injury was the norm during the gilded age when employers had that “right … to determine what level of risk is acceptable within that property.”
Same for the”right to control access to company property.” Again, either Josiah Bartlett is living in an alternative reality where there are no anti-discrimination laws … or Josiah Bartlett is gaslighting us. And, again, I’ll go with the latter. If free-market capitalism can survive government prohibiting employers from excluding customers and employees who, for example, identify as transgender … I’m certain free-market capitalism can also survive prohibiting employers from excluding customers and employees who decline the COVID-jab.
