Nashua parents were delivered a blow tonight when their school board members voted to install a mask mandate on children when they start school. At this time, parents have three choices: comply with the mandate, remove their children from the district, or sue them.
New Hampshire legislators just passed a school choice law that will provide some funding if parents remove their children from a public school. You can also go through the legal process. Parents in surrounding districts are suing their school board members who institute mask mandates. Gathering parents from around the district to cover costs is a way to sue over this decision. Parents are fully capable of determining whether their children should wear a mask or not.
In addition, Nashua Board Policy BBA says:
School Board Powers and Duties: School Boards exercise all the powers and duties prescribed to them by applicable state and federal laws and rules of the State Board of Education.”
If the powers delegated to the local school board come from state and federal laws and rules of the State Board of Education, why are they making school policy that hasn’t been approved by these governing bodies?
If the board members act outside their boundaries, it sure sounds like a good case for a lawsuit. If you sue the board members, and they rely upon their insurance to cover that lawsuit, how would their insurance provider cover these individuals acting in a wrongful manner? Wouldn’t that be a reason not to cover their expenses? This can be a huge mistake for your school board members, and they should know that.
