1. Human rights ought to be protected in all parts of society, public and private, from all bad actors, and the right to bodily autonomy is a recognized human right.
2. According to the Declaration of Independence, governments are instituted to secure the rights of the minority to life, liberty and the pursuit of happiness. Sometimes, the government must step in to prevent powerful private actors from infringing the rights of the minority that don’t have the resources to defend their rights.
3. As a society, we have long determined that private businesses don’t have a right to discriminate, and that includes discrimination against those who refuse a particular medical intervention.
4. A vaccine passport is not the same as a “no shirt, no shoes, no service” policy, because wearing shoes does not pose a medical risk. Vaccines do pose a medical risk and courts have long upheld that we cannot force medical risk on anyone, even criminals.
5. We cannot create a tiered society where those who cannot or will not receive a vaccine are barred from participating. We’ve been down that road before with other modes of discrimination, and we do not want such a regressive idea to take hold. This is a battle we cannot afford to lose.
6. Vaccine passports are a dangerous invasion of personal and medical privacy. This bill is essentially strengthening HIPAA law.
7. The proposed vaccine passport prohibition does not apply to all private businesses. It only applies to private businesses contracted with the state and state and local government. However, the amendment language presents a firm statement that discrimination will not be tolerated in New Hampshire.
