Would a President Romney appoint conservative or libertarian Supreme Court justices?

I have my doubts.

Romney is not a conservative, and has no core conservative convictions so far as anyone can see…. So herewith, an exchange on the subject between me and a worried libertarian friend:

My friend sent me an email with the following observations, with the notation “VERY TRUE WORDS!!!” up at the top of the email. It went like this:

“Political Futures”

“If Mitt wins the nomination, as seems very likely, I will enthusiastically support his candidacy. For my friends who have hesitation on that score, I’d just ask you to keep four things in mind: Justice Scalia just turned 78, Justice Kennedy will turn 78 later this year, Justice Breyer will be 76 in August, and Justice Ginsburg turned 81 about a week ago. We wish them all well, of course, but the brute fact is that whoever we elect as president in November is almost certainly going to choose at least one and maybe more new members of the Supreme Court — in addition to hundreds of other life-tenured federal judges, all of whom will be making momentous decisions about our lives for decades to come. If you don’t think it matters whether the guy making those calls is Mitt Romney or Barack Obama, I think you’re smokin’ something funky.” –columnist Andrew McCarthy

My response:

Republican President Eisenhower gave us Justice Earl Warren.
Republican President Nixon gave us Justices Warren Burger and Harry Blackmun.
Republican President Gerald Ford gave us Justice John Paul Stevens.
Republican President Reagan gave us Justices Sandra Day O’Connor and Anthony Kennedy.
Republican President Geo. H.W. Bush gave us Justice David Souter

The Supreme Court Justices above were (or are) either full-time or most-of-the-time statists, and ignored/overruled the U.S. Constitution either full-time or most of the time. Or they may think the Constitution is a fatally flawed document that should not be used by other countries, as stated by Justice Ginzburg.

So…independent of the mortal danger to all of us posed by a second term for the Obama Presidency, do you really think Romney is going to choose conservative justices? When he doesn’t really even know what a conservative is or what a conservative believes?
