Death of only TRUE First Amendment rally in America? Is “Live Free or Die” DOA?

LFOD Rally

Got an email from Jean Coutu, organizer of the Live Free or Die Rally:

The Town’s demands for a site plan review subject to all boards and abutters’ approvals drove in the death nail on the LFOD Rally.

Today the ACLU refused to intervene due to firearms being at the rally.

We have contacted hundreds of people for help and unless someone is brave enough to come forward soon, it maybe the first case of a true first amendment event squashed in America. What’s next? Porc Fest? The Tea Parties? The Million Man Marijuana March? The article from the Canada Free Press reprinted below is being sent far and wide in order to try and recruit help as a last ditch effort. The event isn’t canceled, but, could be soon.

End of Live Free or Die Rally end of free assembly for America?

By Judi McLeod and Jean Coutu
Saturday, May 30, 2009

Putting it in the vernacular of little people everywhere: “The worst has happened”.

The 4th Annual New Hampshire Live Free or Die Rally is quickly sinking into a quagmire of bureaucratic red tape, and with no 11th hour reprieve on the horizon, chief organizer Jean Coutu may have to cancel.

Billed as the All Free, Only TRUE First Amendment Rally in the U.S., this years Live Free or Die Rally is scheduled for August 21, 22 and 23.

“It looks like it’s finally over.  Not just for us, but for the right to assemble, Coutu wrote Canada Free Press (CFP) in an email today.  “Though I don’t agree with the ACLU on everything, almost every year the ACLU has gone after city hall bureaucrats to get our permits.”

The landscape has changed, dissent is being suppressed in America and now the ACLU is refusing to back the LFDR, in part because of the rally’s Appleseed Project Instructional Shoot Feature–even though it meets all state ordinances.

This is not a good sign for the scores of Tea Parties planned for July 4th. Politically correct and compromised by stimulus money, the bureaucrats of town and city halls decide whether Tea Parties and rallies can be held in their jurisdictions.

Coutu sees it as the death of the right to assemble in President Barack Obama’s USA.

Jean also included the message he is trying to get out to supporters and liberty-loving people everywhere:

Tainted “stimulus.” Transparency? We don’t need no stinkin’ transparency!

JAG Grant

As reported in yesterday’s Daily Sun [PDF], Belknap County has once again decided to go the hard route with former Laconia Mayor Tom Tardif and yours truly, declaring that the two of us “don’t know what” we’re “talking about.” While that sentiment as expressed in the front page headline has no doubt excited certain people that love to degrade those who dare criticize local government, the fact remains that, if anything, the story actually vindicates us and the points we have raised.

First, let’s review a little history… When Tom and I questioned the legality of the appointment process used to replace Sheriff Collis, county “leaders” circled the wagons, going to the mat (and all the way to the NH Supreme Court) to prove us wrong. We all know how that ended—with the removal of the Sheriff, and compliance with law in the subsequent appointment of a new Registrar of Deeds. Yep–We won at the highest court in the state, against a lawyer paid for with our tax dollars, but we didn’t know what we were talking about…

Then there was the time that the County Convention (comprised of the delegation of 18 House members from Belknap County) forgot to have a public hearing on the budget. That little fiasco caused the county to adopt a “default” budget for the first time in memory. Funny, they did it the right way this year. Imagine that? Why would anyone do anything suggested by two clowns that don’t know what they’re talking about? It was around that time that the same pair enlightened county “leaders” as to the meaning and proper procedures needed to create and approve a supplemental budget.

And let’s not forget that occasion when Belknap County decided to borrow monies in anticipation of taxes to cover expenses. While Tom Tardif and I were studying the laws on such a matter, the county “leaders” were apparently otherwise occupied trying to do damage control after the head of finance and administration finally got caught with her fingers in the proverbial cookie jar.

Unfortunately for them, SOMEBODY should have been doing the same research as we were, because, as you might recall, they had to go back to the drawing board and do it, yes, you guessed it—OUR WAY. While claiming we weren’t really right, they followed the procedure as outlined by Tom and me in correspondence with the Convention, the bond counsel law firm, the NH Attorney General’s office, the NH Department of Revenue and the County Treasurer. In other words, this time, they would follow the law.

Fast forward to the present…When it comes to the federal dough (Recovery Act “stimulus” funds) flowing into local law enforcement agencies via the 2009 JAG grant program, it sure would be nice to know if the correct state and federal procedures to add these new monies for budgetary spending were used anywhere, be it here in the Granite State, or throughout the country. The NH Attorney General’s website has the methods by which a New Hampshire TOWN must do a supplemental appropriation when it comes to receiving grants, but is silent on sheriff’s departments and, more specifically, counties.

The letter that Mr. Tardif and I addressed to the County Convention last week outlined the basic problem as the process was conducted by the Belknap County Sheriff. Unlike the law for towns, (RSA 31:95-b) the county has no “go-around” clause for supplemental appropriations & MUST follow existing laws that call for approval by the County Convention as the governing body, not the Commissioners. In this, we are once again shown to be right, as yesterday’s Daily Sun story stated that the

“commissioners have also agreed to seek supplemental appropriation approval as required by state statute should the JAG grant request be funded."

Would this have happened had Tom and I not raised the issue? But we don’t know what we’re talking about, otherwise…

Beyond that, the other big piece to this is the TRANSPARENCY angle. “Oh, Doug, Obama’s gonna make it right– You know, the “new transparency movement” blah-blah and all that!” And indeed, the JAG really does call for transparency. The big question is what happens when it is ignored, as is the case here in Belknap?

NH Groups call on Shaheen to oppose Waxman-Markey Cap and Trade energy tax…

Concord, NH- Yesterday, the leaders of several New Hampshire organizations signed a joint letter to Senator Jeanne Shaheen calling on her to oppose the Waxman-Markey Cap and Trade energy tax legislation. The letter was signed by the leaders of the NH Advantage Coalition, The Coalition of NH Taxpayers, NH 9-12 Project, Cornerstone Policy Research Action, Citizens Leadership NH, Granite State Patriots, and the Seacoast Citizens in Action. [GraniteGrok was among the signers as well]

The letter requests Senator Shaheen to exercise “yankee common sense” and oppose cap and trade energy taxes by urging NH House members Carol Shea-Porter and Paul Hodes to reconsider their support for it. The leaders ask Senator Shaheen to oppose this legislation that “sets inflexible caps on carbon emissions that benefit green market speculators more than our economy” pointing out that this legislation will drive up consumer’s energy taxes. The letter also points out the lack of transparency and continuance of pork barrel politics in the bill.

Former State Senator George Lovejoy, the Honorary Chairman of NH Advantage Coalition stated “although the pristine environment of the granite state is part of our NH Advantage, hammering each household for an extra $1,600 in taxes is not.” He continued “the Waxman-Markey energy taxes threaten to extend and intensify the current recession by increasing costs for New Hampshire families to the tune of an extra $1,600 in taxes of which we don’t have.  From business owners to college grads with loans, people are already struggling”. The letter will be sent to Senator Shaheen office and calls on her to oppose the bill that enjoys support by NH House members Carol Shea-Porter and Paul Hodes.

Here is the letter with signers:

Planned Parenthood: Eliminate the weeds?

planned parenthood

Guest Post by Karen Testerman…

After reading a recent article in World Magazine about the sentencing of a California abortionist for malpractice who "targeted Spanish-speaking women," the question to ponder…Is Planned Parenthood’s primary interest in the industry financial or is their goal more subversive?

According to Jim Sedlak, vice president of American Life League (ALL). "Their [Planned Parenthood] primary focus used to be the African-American community, but about 10 years ago they began writing in their publications about what they call ‘outreach to the Hispanic community.’

Consider a further fact from the article.  "The Guttmacher Institute, formerly the research arm of Planned Parenthood, reports that in 2004 there were 10.5 abortions per 1,000 non-Hispanic white women ages 15 to 44, compared with 28 per 1,000 Hispanic women in the same age group."  Further the Guttmacher Institute reports that "thirty-seven percent of abortions occur to black women, 34% to non-Hispanic white women, 22% to Hispanic women and 8% to women of other races."

BlackGenocide.org states that "78% of their [Planned Parenthood] clinics are in minority communities."  And that "Minority women constitute only about 13% of the female population (age 15-44) in the United States, but they underwent approximately 36% of the abortions."

Now consider that Planned Parenthood founder Margaret Sanger advocated the development of a superior race" by eliminating religious and ethnic minorities she referred to as "useless breeders." In one of her writings, Pivot of Civilization, Sanger refers to African-Americans, immigrants and poor people as "…human weeds,’ ‘reckless breeders,’ ‘spawning… human beings who never should have been born."

Senator Jeanne Shaheen needs to take the lead in stopping Waxman-Markey ‘Cap and Trade’ Bill!

Guest Post by former State Senator George Lovejoy…

New Hampshire Senators sent to Washington have long been respected for their traditional common sense.  It is a long cherished value of the Granite State and on many issues New Hampshire Senators have taken the lead in getting colleagues from both parties to apply this ideal on very critical issues of importance to most Americans.

Such an issue is Congressional motivation to pass Waxman-Markey Climate Change ‘Cap and Trade’ Bill, a proposal now being discussed by the US House, as well as most Americans.  The need for Senator Jeanne Shaheen to step up to take the lead in defeating this consumer costly strategy could not be greater!  This proposal sounds good in the beltway but fails the people miserably as it will increase energy costs to consumers, cost jobs, while doling out free permits to selected industries (see last week’s Wall Street Journal article “Waxman-Markey Bill: It’s Giveaway Time for Emissions Permits”).  With this equation it sounds like everyone is adversely affected by Waxman-Markey; energy producers, consumers and taxpayers, job creators, and the goals set out by the President.  I might not be a fan of President Obama, but what sense does it make to have a policy that is this highly ineffective to every sector of the economy?

Don’t take my word for it – if you are not familiar with the job cuts concern we have, please look at over a half dozen proposed amendments from US Reps in California and Colorado to this bill that calls for an exit clause from this policy that “Suspends the Act should [certain number of jobs lost occur].  There is no doubt that Waxman-Markey will cost American jobs at a critical time with record number unemployment figures from New Hampshire to California.

We urge you to bring common sense to our House members in Washington and demonstrate the common sense approach Granite Staters have come to expect.

The authors of the Cap and Trade bill called Waxman-Markey is an effort to slow what they perceive as climate change with inflexible caps on carbon emission have lost sight on the effect it will have on our personal income or national economy.  It provides no way to protect American consumers.
