Should Pam Bondi Get A Pass?

So, Pam Bondi is Trump’s new nominee for Attorney General of the United States.

Advocates for RKBA point out that she defended Red Flag laws while she was Attorney General of Florida. Others defend her by saying that, as Attorney General, it was her job to defend the laws of the state, regardless of her opinions about them.

I’m not buying this.  For example, suppose the Florida legislature passed a law making Catholicism the official religion of Florida, and the governor signed it.  Should we expect Pam Bondi to go to court to defend the law against challenges to it?

Well, let’s think about that for a moment.  When she took that job, she took an oath of office that begins:

I do solemnly swear (or affirm) that I will support, protect and defend the Constitution and Government of the United States and of the State of Florida

It’s not an oath to defend whatever laws the legislature feels like passing, or even an oath to do whatever her boss (the governor) tells her to do.  If anything, she should have, on behalf of the residents of Florida, taken the side of anyone who challenged Red Flag laws as unconstitutional, as they are on several counts.

So either she understood that they were unconstitutional, and defended them anyway, in which case she was willing to break her oath; or she didn’t understand that they were unconstitutional. In either case, she demonstrated that she’s not qualified to be Attorney General of any jurisdiction.
