Justice Barrett Pledges Government “By the People”

Supreme Court Justice Amy Coney Barrett’s brief speech after being sworn in clearly pinpoints the responsibilities of the Legislative and Judicial Branches of our Government as established in our Constitution to protect the rights of the American people.

“It is the job of a senator to pursue her policy preferences.  In fact, it would be a dereliction of duty for her to put policy goals aside.  By contrast, it is the job of a judge to resist her policy preferences.  It would be a dereliction of duty for her to give in to them.

Federal judges don’t stand for election.  Thus, they have no basis for claiming that their preferences reflect those of the people.”  (Her full statement)

Our Constitution was created to provide a government “Of the people, by the people, and for the people”, i.e., controlled by the people.  This means that Americans are to be governed with laws written by their elected representatives whose actions can be reversed by the people by replacing their elected representatives.

The primary restriction on the laws written by our legislators is that they must be exercising authorities surrendered to the government by the people in the Constitution.  Consider the Constitution like a contract or a power of attorney; neither party can unilaterally change the terms of the agreement.

Conservatives believe that the Constitution can only be changed by the Amendment process specified in the Constitution as that is the only way for the people to be in control of their government.

Leftists believe that a simple majority of Supreme Court Justices can change the Constitution and substitute their preferences for the will of the American people…this is not the government “by the people”.

Only with the American people in control of our laws and Constitution does our government govern legitimately.
