With the death of Supreme Court Justice Ruth Bader Ginsberg, the Democrats have threatened, like FDR did, to “pack the Court” by adding new Justices if Trump and the Republicans ram through a replacement for RBG as soon as possible. Governor Sununu, as Grokster Doris pointed out (In Emergency Order #69, Sununu Packs the Public Health Ethics Committee), is going to do a similar action – sorta sideways, but similar.
FDR’s threat was because a Conservative SCOTUS kept ruling that his policies were unConstititional. FDR’s thinking precedes Sununu’s by 80 years but his reasoning was similar. In Sununu-speak, it would be “Financial Health Trumps Everything” as he decided that the Constitution was limiting his ability to get the nation out of the Depression. History has shown that those efforts actually prolonged the Depression and only when WWII broke out and we went to full employment did the Depression wane. Because the Supreme Court, at the time, was properly slapping him down, in a pique of “Do you know who I AM!!!”, he threatened to “pack the court” with additional Justices he knew would be lapdogs and rubber stamp his policies over the objections of the Conservatives then a majority on the Court.
Sununu’s actions of “Public Health Trumps Everything” is similar in mindset (“I MUST BE DOING SOMETHING UNILATERALLY”) in many of his Emergency Orders. As Doris points out, it is the Ethics Committee that is getting “packed” with his appointees. It is clear that he’s become FDR in this manner.
Translation, in part, from my opinion? His goal is to keep milking this “pandemic” for all its worth. Hey, the Democrats running the Senate and House have been “rubber stamping” his actions from the get go – they, at ANY POINT IN time, could have called their chambers back into active session and put a stop to it.
They didn’t. They refused. They have kvetched now about his vetoes, but said nothing about him taking over their Powers. Instead of “jealously guarding” those Powers as our Founders believed the would, they, too, rolled over belly up and went quiet. They allowed him to be both the Legislative AND Executive Branches – they have no one to blame but themselves. But, then again, as Democrats, they generally don’t care what’s in the Constitution anyways.
I guess, as Doris intimated, they liked having a King. And having their lunch money stolen at the same time.
So the question remains – WHY has he chosen this action? I see nothing in the past, as FDR did, that would have provoked this. Which, by Occam’s Razor, only leaves the question:
What has Sununu planned in the near or mid-term future in which subsuming the Ethics Committee to his will would be critical?
