An Amendment to Enshrine the Death Penalty in the New Hampshire Constitution

My testimony to the NH House Judiciary Committee on Wednesday, January 22, 2020, in opposition to constitutional amendment CACR 14.

Dear members of the committee,

If CACR 14 passes, the New Hampshire Constitution would state:

The right to make personal reproductive medical decisions is inviolate and fundamental to the human condition. Neither the State nor any political subdivision shall infringe upon or unduly inconvenience this right.

This would mean no more parental notification for minors having abortions. It would mean that the New Hampshire taxpayers would be forced to pay for abortions. It would mean an end on the ban on partial-birth abortions. And it would mean that we could have no future restrictions of any kind on abortions, not even in the third trimester.

The vast majority of people support restrictions on third-trimester abortions because ultrasounds are ubiquitous. They see the clear humanity of the baby a few weeks away from being born.

  •  Imagine how many more would support restrictions if they knew that a third-trimester abortion cannot be used to save a mother’s life because a late-term abortion takes multiple days. In a medical emergency, a baby can be delivered quickly with a Cesarean.
  • Imagine how many more would support restrictions if they knew that a healthy baby delivered in the third trimester has an excellent chance of surviving and thriving with modern neonatal care.
  • Imagine how many more would support restrictions if they saw all the tiny, precious babies in the NICU and realized that they are the same age as babies it is legal in New Hampshire to abort.
  • Imagine how many more would support restrictions if they knew that third-trimester abortions were performed by injecting poison in the baby’s heart and then crushing the skull and suctioning out the brains before the dead baby is delivered?

I know many of you supported the bill to ban the death penalty for those convicted of serious crimes in New Hampshire. Please vote Inexpedient to Legislate on this amendment so that we can someday protect babies from the same fate.
