House Election Law Chairman Files Complaint Against Former NH Democratic Party Political Director Over 78 Fake Endorsements
Berry asks the Attorney General to seek the toughest penalty the law allows: up to a year in jail.
WEARE — State Representative Ross Berry (R-Weare), Chairman of the New Hampshire House Election Law Committee, filed a complaint on Sunday, October 11, with the Attorney General’s Election Law Unit against Sebastian Fuentes, former Political Director of the New Hampshire Democratic Party, for publishing 78 fake endorsements in violation of RSA 666:6. Berry is asking the Attorney General to seek the toughest penalty the law allows: a class A misdemeanor, punishable by up to one year in jail.
“This was not a mistake. It was a lie, built 78 times and aimed at voters weeks before an election,” said Berry. “Sebastian Fuentes ran the political department of the New Hampshire Democratic Party. He knows exactly what an endorsement is and who gives one. He put another organization’s name on endorsements it never made, and he told people to spread them town by town.
“New Hampshire Democrats are so obsessed with Free Staters that they are willing to lie to voters about them. When the truth does not help them, they make up endorsements. This is not some anonymous troll. This is the New Hampshire Democratic Party’s own former political director, a paid strategist for Congresswoman Maggie Goodlander’s campaign, and Democratic town committees spread his work. The New Hampshire Democratic Party owns this. It must take these graphics down and tell voters the truth, and Congresswoman Goodlander must denounce them.
“I chair the committee that writes New Hampshire’s election laws. They mean nothing if they are not enforced. If you can fabricate endorsements and walk away with a warning letter, everyone will do it. I am asking the Attorney General to treat this as the crime it is.”
On October 10, Fuentes posted 78 graphics to Facebook, each headed with the name of a New Hampshire community. Each carries the Free State Project’s logo and the word “ENDORSED” above the names of candidates: 136 in all, 135 of them Republicans on the November ballot, including Berry. The Free State Project endorsed none of them. It does not endorse candidates, and as a 501(c)(3) organization, it cannot. On October 11, the Free State Project issued a public statement that the graphics are false: https://www.fsp.org/news/free-state-project-statement-on-false-candidate-endorsement-claims/
Berry’s complaint shows Fuentes knew the endorsements were false:
• He is the former Political Director of the New Hampshire Democratic Party, Vice Chair of the Grafton County Democratic Committee, and a 2024 Democratic National Convention delegate.
• He is a paid political strategist. Federal filings show Congresswoman Maggie Goodlander’s campaign paid him $5,000 this year.
• Five days before the post, he appeared in a video teaching voters New Hampshire voter registration law, including that the form is signed under penalty of perjury.
• In August, he used the Free State Project’s logo, crossed out, to label candidates “aligned.” In October, he used it to label them “ENDORSED.”
The fake endorsements spread fast. By the next afternoon, the post had been shared 123 times. Democratic committees in Windham and Rochester reposted the graphics, and the Windham Democrats told voters that three named Republicans “are endorsed by The Free State Project.”
RSA 666:6 makes it a crime to use another’s name by false representation to signify an endorsement of candidates for the purpose of influencing votes. In 2023, the Attorney General won a guilty plea under the same law against a Merrimack man who posted a fake ad during a 2021 special election. He lost his right to vote.
