PAYNE: Repeal the 17th Amendment

Our Founding Fathers, taught to read from the bible on their mother’s knee, knew the good book was the foundation of the holy cause of liberty. The Preamble clearly revealed its biblical source: to establish Justice from (Amos 5:15); to insure domestic tranquility (1 Timothy 2:2); to provide for common defense and the general welfare (Romans 13:4). It is no accident that our three branches of government are derived from Isaiah 33:22 ”For the LORD is our judge (Supreme Court); the LORD is our lawgiver (Congress); the LORD is our king (Executive),  it is he who will save us.” 

Revealing the biblical evidence, the Founders held themselves accountable to God alone. The cultural rock that Sam Adams confirmed with the war cry of the American Revolution: “No King but King Jesus.” Jefferson describes the Constitution as “…not an instrument for government of the people, but an instrument for limiting government” so that the people remain sovereign. 

Our Founders’ biblical wisdom soon came under attack when the Marbury v. Madison Supreme Court ruling established the doctrine of Judicial Review in 1803.  Chief Justice John Marshall’s words initiated a major attack on the power of the people to rule themselves by stating, “It is emphatically the province and duty of the Judicial Department to say what the law is.” Since then, five justices, in their opinions, have superseded congressional law, reversing original intent.  

After two and a half centuries, these eternal truths that have blessed us with unparalleled liberty have been pushed aside by the rewriters of history. Each generation knows less about what truly went on before their birth. Consequently, twentieth-century Americans became victims of a wolf in sheep’s clothing in the White House. Fabian-Socialist President Woodrow Wilson, under the deceptive crusade to “make the world safe for democracy,” took another hatchet to the U.S. Constitution during his Administration. Starting in 1913, two mandates from the Communist Manifesto became law: (1) the graduated income tax (16th Amendment) and (2) the central control of credit by the State (Federal Reserve Act). 

In addition, by removing powerful limitations on the Federal government, the 17th Amendment allowed the direct election of Senators, fanning the flames of the consolidation of federal power. State sovereignty was endangered when direct election of Senators replaced State Legislature appointments. The Founders’ intent for Senators to represent the State was a counterbalance to popular choices politicized to sway we the people. Thereby, Senators were beholden to protect their State’s interests. If national deficits occurred, the debt was shared among the States in proportion to their population, so deficits were a natural deterrent to reappointment.

By and large, most patriotic movements ignore how direct election of Senators has taken power away from the States and had a major impact on moving the country away from constitutional principles. It is encouraging that nine American constitutional patriots have cosponsored Rep. Keith Self’s (R-Texas) H.J.R. 198 to Repeal the 17th Amendment.  As in all wars, legislative wars must be won by the foot soldiers. Nine men have stood up for the wisdom of our Founders’ check-and-balance system. They have done their job; Get on the phone and do yours.
