For all the talk of not politicizing the US Supreme Court, if that hadn’t already been the case for Decades, someone behind the Robes has released a draft decision breaking centuries of tradition and “president.” It is a decision that overturns Roe v. Wade.
Overturning Roe itself doesn’t change much. States have been writing Abortion laws for longer than there has been a called Roe v. Wade. That will continue. Regulations already in place will not change immediately. States that have stricter statutes will maintain them. But local legislatures will be free to modify them as the people who elected them see fit.
That’s what steams the Left.
Assuming the leaked Draft tells the real story.
“We hold that Roe and Casey must be overruled,” he writes in the document, labeled as the “Opinion of the Court.” “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.” – Justice Alito
According to Politico, the majority opinion (no one seems to know where Chief Justice Roberts lands on this) is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision – Planned Parenthood v. Casey – that largely maintained the right. “Roe was egregiously wrong from the start,” Alito writes.
“We hold that Roe and Casey must be overruled,” he writes in the document, labeled as the “Opinion of the Court.” “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”
But a draft decision is not the final decision. Rewrites and debates could result in a different outcome altogether. It may already have. I’m not clear on when final rafts get completed or what that process is. But with what we know and suspect, given the makeup of the nation’s highest court, Roe and Casey are about to be flushed, and the Left will lose its collective mind.
It will, with all haste, make every effort to intimidate anyone, even Supreme Court Justices, if they think it will save the Constitutional right to kill people before they have a chance to defend themselves.
