Dear Laconia School Board,
We are a group of administrators and others in the Laconia School District that are part of the complaints lodged resulting in the investigation of the Superintendent, Steve Tucker.
You are inviting the “Streisand Effect” upon yourself. What is “The Streisand Effect,” you ask? Well, as these three are about to find out, it is a blogger’s delight:
The Streisand effect is the phenomenon whereby an attempt to hide, remove, or censor a piece of information has the unintended consequence of publicizing the information more widely, usually facilitated by the Internet.
It is named after American entertainer Barbra Streisand, whose 2003 attempt to suppress photographs of her residence in Malibu, California, inadvertently drew further public attention to it. Similar attempts have been made, for example, in cease-and-desist letters to suppress numbers, files, and websites. Instead of being suppressed, the information receives extensive publicity and media extensions such as videos and spoof songs, often being widely mirrored across the Internet or distributed on file-sharing networks.[1][2]
Congrats – you just done that.
Doesn’t matter who sent that email, doesn’t matter (actually) how it came into my possession – every member on the Board received it. It doesn’t matter if you don’t like it, it doesn’t matter if it holds mere “allegations”, and it doesn’t matter if it implicates you (which is the real reason why I think you are trying to suppress it). Remember, it is you who I called out for violating The Law – RSA 91:A. Sounds like you did it a couple times more (what, on your good looks alone)? That puts you more at risk, doesn’t it?
The only person who is putting “the board, and the district to significant liability” is you, from what I’ve heard, in violating RSA 91:A in having non-noticed meetings at which there were quorums. A public document, that can be demanded by an RSA 91:A demand, poses no liability at all. And if the school staff all know about the investigation of Super-(nincompoop)-intendent Steve Tucker, it may be a personnel matter but it is ALSO a publicly known matter.
In fact, consider this my RSA 91:A demand for the email that you’re kvetching about – and you certainly can’t deny that you have it, can you?
Pursuant to the Right to Know Law (RSA. 91-A), I am demanding access, within 5 business days, to the below enumerated governmental records Otherwise, in not within the mandated 5 business day window per RSA 91-A, please advise when the Responsive Records will be made available.
This request is for all Laconia School Board involved emails for the time period from Thursday, December 16, 2021 to today (December 26, 2021):
- Individual outbound emails from any and all email accounts provided to Laconia School Board members as part of their elected office service.
- Individual inbound emails to any and all email accounts provided to Laconia School Board members as part of their elected office service.
The information for each responsive record shall include:
- TO fields, FROM fields
- CC fields, BCC fields
- DATE fields
- SUBJECT fields
- And the Body of the email itself.
The responsive records will also include the December 17 email from “Anon Anon” as it is clear that it is a responsive record. I remind you that all electronic records, per RSA91:A are to be kept for the same time period as hardcopy records. It is expected that this email will be part of those responsive records.
It should also include the December 19th email you sent to Laconia School Board member Dawn Johnson, Superintendent Tucker, and Asst Superintendent Hinds. Those two will serve as verification markers that all responsive emails are all inclusive.
Per RSA 91-A:4 IV(c) If you deny any portion of this request, please cite the specific exemption used to justify the denial to make each record, or part thereof, available for inspection along with a brief explanation of how the exemption applies to the information withheld.
As you are aware, in 2016, the New Hampshire Supreme Court ruled that a governmental body in possession of records is required to produce them in electronic media using standard of common file formats: Green v. SAU #55, 168 N.H. 796, 801 (2016). Unless there is some reason that it is not reasonably practicable for you to produce these records in the requested format, I ask that you either do so or explain why it is not practicable for you to comply.
Please let me know when these records will be sent so me for inspection.
