NH is about to Become a Second Amendment Sanctuary State

By a vote of 199-177, the New Hampshire House has passed Senate Bill 154 (SB154). If Governor Sununu signs it, this will make New Hampshire a Second Amendment Sanctuary State.

 

This bill prohibits the state of New Hampshire, a political subdivision of this state, or any person acting under the color of state, county, or municipal law from using any personnel or financial resources to enforce, administer, or cooperate with any law, act, rule, order, or regulation of the United States Government or Executive Order of the President of the United States that is inconsistent with any law of this state regarding the regulation of firearms, ammunition, magazines or the ammunition feeding devices, firearm components, firearms supplies, or knives.

 

Knives, too, because we’ve seen what they are doing in London, and that’s crazy stuff, so that’s a good addition.

But wait, there’s more:

 

“Silence in the New Hampshire Revised Statutes Annotated pertaining to a matter regulated by federal law shall be construed as an inconsistency for the purposes of this chapter.”

 

But wait, there’s more:

 

“If any provision of this chapter or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of the chapter which can be given effect without the invalid provision or application, and to this end the provisions of this chapter are declared to be severable. “

 

If the existing statute makes no specific mention, the state must still hold to SB154. And if any part of the bill becomes invalid, the rest is still enforceable.

The original bill was not so comprehensive. It started as little more than a blocking mechanism for Biden’s anticipated anti-gun Executive Orders.

In early January, I pleaded for a sanctuary bill and shared some content from Bearing Arms suggesting they draft the bill to look like California’s illegal alien sanctuary laws. Those laws have stood up to court challenges and were crafted with language that, if challenged on 2A sanctuary, would undermine illegal alien sanctuary.

Winning!

SB154 says that the state will not allocate resources of any kind to administer or cooperate with the enforcement of federal laws regarding firearms (and knives!) inconsistent with NH law.

That’s another reason the left will hate it.

No federal red flag laws. No “assault weapons” bans. The list is long, and it will make Democrats cry.

Will it become law?

We give the Governor a lot of crap because he brings it on himself, but to date, he’s been good on guns and taxes. You can’t count on him for much else, but these two things continue to run in the vein of true constitutional conservatism.

My expectation is that he will sign it.

It takes effect immediately.

And much like when Mr. Sununu signed the constitutional carry bill a few years ago, the Democrats will lose their minds, promise us blood in the streets, and nothing they say will come to pass.

Because they lie. A lot. And it will be the first thing they move to rescind if they get the majority and a Governor who will help.

We’d appreciate it if y’all would do what you can to prevent that.
