Judge Orders Church to Shutdown

A judge orders a church to shutdown. This seems pretty unconstitutional.  Why is there no injunction to shutdown demonstrations in Portland, Seattle, Minneapolis, etc? Nobody is saying anything about the riots, protests, and marches.

And what about the funerals of John Lewis and George Floyd? Crickets … But let a meeting be religious rather than political. Guess what? People lose their minds. OMG… they can’t do that… Why not you hypocrite?

Seriously, does anyone doubt that the virus is being explicitly politicized? Prisons are emptying, in line with leftist policies. We don’t want felons getting sick in prison. Really, and why not. They did the crime, they should do the time. Isn’t that why the prisons were built… to isolate those who exhibit anti-social behavior?

The order seems politically based

Some churches that stand in the way of leftist policies. They must be shutdown. But it’s okay to use political events as a pretext for violent uprising? Those are expressions of First Amendment rights, too. Wait, religion is part of the first amendment in two separate phrases.

Congress shall make no law respecting an establishment of religion…. Congress shall not make any law prohibiting the free exercise thereof… So why does the judiciary think somehow it has the right to infringe the free exercise? Why did a judge orders church to shutdown?

A California judge has hit a church with a restraining order over worship. Since May 31, the Newbury Park church has held large, indoor services. They are happening without masks or social distancing every Sunday. Ventura County health authorities are suing Godspeak and McCoy. McCoy said the services included “singing, hugging, no masks.”

The judge’s reasoning

According to the Thousand Oaks Acorn, Judge Matthew Guasco said, “The Constitution is not a suicide pact. The exercise of individual liberties has to be consistent with public health; otherwise the one would cancel out the other…”

County Public Health Director Rigoberto Vargas said everyone must follow health guidelines. He reasons this is mandatory so business and schools can resume. He says, “the most vulnerable in our community can be spared from the disease.”

County Health Officer Robert Levin says, “It is only a matter of time… if it has not already happened… before there is a significant outbreak of COVID-19 cases among the attendees…” Levin is a plaintiff in the suit. The lawsuit came after members of the Ventura County Board of Supervisors voted 3 to 2 this week. The majority favor use court actions to enforce COVID-19 health orders.

The temporary restraining order will remain in effect until Aug. 31, 2020. Another hearing on the lawsuit is on the schedule for that date. Since the membership of the church is known one would think it would not be difficult to determine whether a public health concern exists. This has been going on for months. One would expect to see a spike if this activity is cause for concern.

Tyranny: What is legal for the government but illegal for the citizenry

One assumes the spread happens in the political crowds. First Amendment protection is being carefully taken into considerations for them. Look at Portland. There Ethan Snyder says he was been out with protesters for seven days at the beginning of June.

Then last Friday, the 19-year-old started feeling tired and had a fever. He went to a drive-thru testing facility. He got confirmation of contraction of coronavirus. But that’s okay with the courts. Noe this is a case of the courts making something okay for government that isn’t okay for the people. That dear reader is the definition of tyranny.

Courts, politicians and perhaps most importantly bureaucrats are prioritizing shutting down churches. That in and of itself is a political action against the “Bill of Rights”. They are defending politics as an expression of Constitutional rights.

A allegation of the possibility of a significant outbreak among religious the attendees’ is the argument. No proof was proffered. Yet, there is an abridging constitutionally protected rights? But nobody dares make that argument in Portland and Seattle. There it would be made in the face of statistical disease spikes. These are places where there is a correlation between the political activism and a virus spike.
