Breaking: Judge rules that Gov. Sununu, not the Legislature, has authority to spend COVID19 Fed money

I’m betting that the Democrat majority on the Legislature Fiscal Committee are mad as hornets given that this gift of our money by the Feds to NH is not going to be handed out to their special interest groups as easily as they first thought. Sununu did include most of those same politicians.  However, he keeps control.

Conclusion
Although the Court recognizes the gravity of plaintiffs’ allegations and the need for them to be addressed swiftly, it cannot abdicate its responsibility to ensure that it has jurisdiction over the subject matter of proceedings before it. “In light of the overriding and time-honored concern about keeping the Judiciary’s power within its proper constitutional sphere, [the Court] must put aside the natural urge to proceed directly to the merits of an important dispute and to ‘settle’ it for the sake of convenience and efficiency.” Duncan, 166 N.H. at 648.

Therefore, in light of the foregoing, plaintiffs lack standing to pursue the present action. In the alternative, even assuming plaintiffs had taxpayer standing, they are not entitled to preliminary injunctive relief.

Accordingly, Governor Sununu’s motion to dismiss is GRANTED

It will be interesting, as well, how “nice” they will play on Sununu’s committee or whether or not they are going to keep trying to take judicial bites at the apple or foment a “legislative rebellion” to put roadblocks in the way. They know that Sununu’s best bet to get re-elected is to get the economy reved up; their route is to screw that up (with the secondary “win” is to get $$$ to their SIGs and donor groups – that’s how they work).
