Dem NH State Rep Katherine Rogers is mandating your dog be inside all the time?

Just one more example of NH Democrats not trusting “We the People” to “behave” correctly. Katherine Rogers is a serial offender in this matter as she is telling all of New Hampshire that you can’t be trusted to treat your dogs right – even those that should be out in the cold as “working dogs”.

This whole thing is a sop to “Animal Rights” activists who believe that NO ONE should own a pet at all. If you can’t persuade people to give up pets on their own (like Katherine Martinko at Treehugger here and at the end of this post), make it SO ONEROUS to have one, people will give up.

Translation: Democrats delight in taking stuff away from you. Especially your dog.

From a tip emailed to me on a post at Sportsmen Alliance (reformatted, emphasis mine):

Unless you are prepared to invest in a dog house that meets building code standards created by the state, a new bill in New Hampshire would make it illegal to leave your dog outside for more than 30 minutes, even in a fenced in backyard!

State Representative Katherine Rogers’ legislation, which is modeled after similar bills introduced in other states, would also make it a crime to leave a dog outside more than 15 minutes when the temperature is below 32 degrees, even if there is shelter provided.

My two dogs, a Manchester Terrier and a Lab/Pit mix, are pretty much indoor dogs; they just lay around all day and bark at stuff that goes by the slider. That said, they often are outside.  They tell us when they want to go out and we wait until they tell us (barking) when they want to come. And, often, it is for much more than 15 minutes.

They aren’t hunting dogs, they aren’t working dogs – they are personal pets. But as anyone knows, dogs aren’t stupid and our two are quite good at communicating their needs. So if Ms. “I want dogs treated better than the senior citizen woman I physically assaulted” Katherine Rogers wants to come over with a stopwatch and sit in the cold herself, bring it.

I dunno about you all, but I’m getting tired of other people, ESPECIALLY Democrat Socialists that believe we can’t live our lives properly without them hectoring us all the time. And they are getting worse and worse these last few years. And of course, I’m not surprised by the “monkey see, monkey do” attitude that NO policy should remain in just one State. The Democrats are all in on making EVERY state philosophically and legislatively exact copies of each other – that can be no differences within the Collective!

House Bill 1389 specifies that dog shelters must be 3 inches above the ground and include an 8-inch overhang above its entrance. The bill makes no allowance for breeds of dogs that are accustomed to colder weather, or for sporting dogs and working dogs which must be acclimated to colder weather to safely perform their duties. Under HB 1389, a person who lets their dog outside in the backyard for more than 30 minutes on a 70-degree day would be breaking the law unless they had a doghouse that meets state standards. Repeat violators of this new language would be charged with felony animal cruelty!

“Any person familiar with hunting and sporting dogs knows that a key component to keeping them safe and healthy is the ability to acclimate them to conditions that they will encounter in the field,” said Bruce Tague vice president government affairs for Sportsmen’s Alliance. “In addition, criminalizing keeping a dog in the backyard on a nice day is insane.”

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty

AN ACT relative to criminal penalties for not providing adequate food, water, and shelter for animals.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1  New Paragraphs; Adequate Food and Water.  Amend RSA 644:8 by inserting after paragraph II-a the following new paragraphs:

II-b.  In this section, “adequate food and water” means access to clean, fresh, potable water of a drinkable temperature that is provided in sufficient volume, in clean, durable receptacles that are accessible to each animal, and at suitable intervals appropriate for the weather and temperature, to maintain normal hydration for the age, species, condition, size, and type of each animal; and access to and the provision of food that is of sufficient quantity and nutritive value to maintain each animal in good health; is accessible to each animal; is prepared so as to permit ease of consumption for the age, species, condition, size, and type of each animal; is provided in a clean and sanitary manner; and is provided at suitable intervals for the species, age, and condition of the animal, but at least once daily, except as prescribed by a veterinarian.

II-c.(a)  For any dog left outside and unattended for more than 30 minutes during any period, the dog shall be provided a shelter that is moisture-proof, wind-proof and of suitable size to accommodate the dog, allowing for freedom of movement to make normal postural adjustments, including the ability to stand, turn around and lie down with limbs outstretched.   Such shelter shall be made of durable material with a solid, moisture-proof floor raised at least 3 inches from the ground.  The roof shall extend 8 inches over the doorway and not permit rain to enter inside the shelter.   Such shelter shall not be constructed of metal or any other material that readily conducts heat or cold.

(b)  Between October 1st and April 30th, all structures shall have a windbreak at the entrance and shall contain a sufficient quantity of suitable, clean bedding material consisting of straw, cedar shavings, or the equivalent and provide insulation appropriate to local climate conditions and sufficient to protect against cold and dampness.  Hay, blankets, rags and other materials that retain moisture shall not be utilized for bedding.

(c)  Between May 1st and September 31st of any year, all dogs shall be given access to one or more areas of shade by natural or artificial means large enough to accommodate the entire body of the dog at one time to provide protection from the direct rays of the sun.  Such shaded area must be separate and outside of any shelter.

(d)  No dog shall be left outside and unattended, regardless of access to an outdoor shelter, for more than 15 minutes during any period in which a severe weather advisory or warning has been issued for the area by the National Weather Service, or if the temperature is below 32-degrees Fahrenheit or above 90-degres Fahrenheit.  This includes but is not limited to a dog in a securely fenced in yard, a dog in a kennel, or a tethered dog.

2  Cruelty to Animals; Negligence; Adequate Food and Water.  Amend RSA 644:8, III(a) to read as follows:

(a)  Without lawful authority negligently deprives or causes to be deprived any animal in his or her possession or custody necessary care, adequate food and water, sustenance or shelter;

3  Effective Date.  This act shall take effect January 1, 2021.

METHODOLOGY:

This bill contains penalties that may have an impact on the New Hampshire judicial and correctional systems.  There is no method to determine how many charges would be brought as a result of the changes contained in this bill to determine the fiscal impact on expenditures.  However, the entities impacted have provided the potential costs associated with these penalties below.

Many offenses are prosecuted by local and county prosecutors.  When the Department of Justice has investigative and prosecutorial responsibility or is involved in an appeal, the Department would likely absorb the cost within its existing budget.  If the Department needs to prosecute significantly more cases or handle more appeals, then costs may increase by an indeterminable amount.

Like I said, Katherine Martinko has decided that she will never have a dog.  No, not for the reasons that Animal Rights are demanding (e.g., no one should EVER own an animal – that’s degrading to the animal to think of it as property. No, she doesn’t want to be responsible for its carbon footprint.  Now, she can go on a two week foreign trip after mewling about everybody’s carbon footprint for years, but no pets/dogs for her kids EVEN AS THE POST’S PICTURE IS OF A YOUNG BOY HUGGING A DOG. There’s something magical and awe-inspiring about animal interactions that has yet to be explained by science……..I agree, and do not have any pets for this reason.

And yet you chose to use a child holding a pet dog for this post’s image?

Ever have a dog or cat, Katherine, as a child?

Think now of the joy of that child and dog; you’ve chosen to remove that joy from your own children? They they will never experience the unadulterated and all-encompassing love that a dog (and cats; dunno about others) GIVE to their humans? There is a very special bond that develops that cannot be replaced by simply watching a moose in the woods (btw, here in NH, if you see one, you’d better start backing away. I wouldn’t say quickly but it had better be steady especially if during rutting season or it’s a mother with its calves – they WILL kill you).

I knew as a child that when all was going wrong and my parents were yelling at me (generally for cause but not always), I could always depend on my dog to always giving that unconditional love that a child can sometimes need.

Over a stinking gas???

This is why my take is that environmentalism has become so rigid it is a religion to its adherents
