“…Tuesday night’s massive dump of State Department emails shows that Secretary of State Hillary Clinton was exchanging emails with another man also named David Axelrod. It must be a different guy, because the one warning about the “email trap” didn’t know anything about Clinton’s private email server and personal email address.”
The EPA’s power plant regulation overreach just got the thumbs down from the US Supreme Court. I’m formatting Justice Scalia’s decision for the majority (complete EPA decision on MICHIGAN ET AL. v. ENVIRONMENTAL PROTECTION AGENCY ET AL. here) to post for the wonky folks who like to get into the weeds, but for now I’ll leave you with this.
Turning to the mechanics of the hazardous-air-pollutants program, EPA argues that it need not consider cost when first deciding whether to regulate power plants because it can consider cost later when deciding how much to regulate them. The question before us, however, is the meaning of the “appropriate and necessary” standard that governs the initial decision to regulate.

The Federalist has what it describes as Justice John Roberts 11 most devastating quotes from his dissent on the recent SCOTUS Gay Marriage decision.
They are all excellent observations. They do make the majority argument look silly. But you have to wonder where this Justice Roberts was when they were handing out the decisions in King v. Burwell.
I say that because neither decision, regardless of what issue they decided, is based on rule of law, or any Constitution I am familiar with, yet this dissent from Roberts speaks to both the rule of law, constitutions–and the separation of powers (to add insult to injury). So where was this man when confronted with the very plain language “passed” in ObamaCare by the law-making branch and signed in to law by the law enforcing branch?

In today’s Concord Fishwrap (no offense to fish), you’ll see another editorial about guns. Yet another vapid.repetitive.attempt to imply that the backwater, 18th century Founding Fathers had no idea, when they wrote the muskets-only Second Amendment, that semi-automatic firearms would ever be invented.
Had the editorial’s authors only been there to tell them, the Founders would have surely backed away from this senseless, antiquated section of 27 words. Right?

“On June 23rd, a Merrimack County Superior Court jury returned a verdict on all counts for Lorin Mulligan against the Town of Henniker. The Henniker Water Department built an access road for commercial trucks across her property to the Town’s water tank on abutting land. Despite her repeated protests and the clear language of her deed, Henniker chose to build the road anyway with little or no regard to her private property rights. She was left with no option but to defend her constitutionally protected property rights through an arduous litigation process.
It amuses me to no end when Republicans (individuals, groups, so-called advocates, candidates, politicians, party leadership) tell us that we must compromise on our principles to “have a seat at the table.” Compromise is part of politics but shouldn’t we be looking for leaders who are more interested in getting the opposition to sit at our … Read more
