Judge Throws Out House Democrat Lawsuit Over Trump Funding Solution for Border Wall

When Mr. Trump failed to get enough funding for the Border Wall, he looked for unspent authorized funds elsewhere. Democrats immediately filed a suit to block the Executive Branch from using that money to secure the southern border. A judge just threw it out.

The thrust of the opinion is this. The Legisaltive branch has powers it can use to counter the Executive it is therefore not the role of the Judiciary to take sides in what appears to be a political fight.

“The House retains the institutional tools necessary to remedy any harm caused to this power by the Administration’s actions. Its Members can, with a two-thirds majority, override the President’s veto of the resolution voiding the National Emergency Declaration. They did not. It can amend appropriations laws to expressly restrict the transfer or spending of funds for a border wall under Sections 284 and 2808. Indeed, it appears to be doing so.”

Lacking a specific “injury” that only the courts could address the Judge ruled that House Democrats lacked standing.

An appeal seems imminent. All part and parcel of using the justice system to slow or stop things until Democrats can regain control of whatever feature of government vexes them.
