Dear Representative Scherr,
Thank you for your Op-Ed in “In Depth New Hampshire.” Unfortunately, not only is the Supreme Court’s statement on Dianne Martin incorrect, but the JCC’s statement of October 28, 2026 regarding Anna Barbara Hantz-Marconi is also incorrect.
That statement says that Anna Barbara Hantz-Marconi returned to the Supreme Court in October 2025 but did not participate in oral hearings. This is directly contradicted by contemporaneous reporting from October 2025 and Supreme Court Appeals in which she actively asked questions to presenting attorneys. NHPR and WMUR are among those reporting alongside InDepth.
Another issue: Gordon MacDonald’s legal counsel, Jane Young and Mark Morrissette, stated on August 19th, 2026, that Gordon MacDonald was “unable to provide any direction at this time”.
When the September 8th JCC Stipulation happened, was Gordon MacDonald able to provide direction to his legal counsel?
When he resigned on September 15th, 2026, was he in a fit state to sign? Was he forced to sign without providing direction of his wishes? Did someone else (his legal counsel?) sign for him?
If his legal counsel signed for him, or made him sign when he was unable to provide direction, that would put his legal counsel in the position of being both his advisor and acting under Power of Attorney for someone unable to provide direction for himself.
What are the implications of this, given that Jane Young is also on the Screening Committee of the ADO and has been since January 1, 2025 (according to the PCC), which is a day before she announced her resignation as US Attorney, with her last day on January 17, 2025? Applications for the positions open on the ADO were due by mid-December 2024. Did she submit an application, or did Gordon MacDonald seek her and put her in that position for selfish reasons?
What are the implications for the credibility of the NHBA when Jane Young is also the Vice President of the NHBA and the governing board of the NHBA falls under the supervision/jurisdiction of the Supreme Court? Similarly, so does the ADO.
The September 15th, 2026 resignation letter does not mention Dianne Martin as being the reason for MacDonald’s resignation. For all we know, that is the public-facing reason, and the JCC and Supreme Court have not divulged anything else. Why did none of them have a problem with the optics of conflicts of interest for Richard Lehmann representing both the Senate and the Supreme Court and its collective and individual justices? What does Senator Sharon Carson know? What do other Senators know? Why don’t they have a problem with the dual representation, and why doesn’t the JCC?
Is it possible that the JCC resolved the issues with Anna Barbara Hantz-Marconi in order to avoid a public hearing in December in which it would be expected that Gordon MacDonald would be a key witness?
One of them was lying about whether or not MacDonald had told Hantz-Marconi she could approach Governor Sununu. Following Erin Creegan’s arguments that MacDonald should not have to speak under oath at trial, the optics don’t look great for him. Creegan reportedly provided counsel to MacDonald before his appointment as AG. Then, from June 2023, she gave counsel to the Supreme Court. Yet, it appears (from records I could find), that she didn’t become a member of NH Bar until July 2023. And now she is US Attorney, taking with her AV Harris, the communications director who had worked for MacDonald on the Supreme Court.
Eleven months ago (and after the Supreme Court’s untruthful statement about Dianne Martin), Donovan, Countway and Gould heard the appeal of David Meehan re YDC. There’s still no decision. Should anybody trust a decision when it comes?
Consider the history:
As AG, Gordon MacDonald dismissed the YDC cases for “victim negligence.” That was when Russ Rilee represented Meehan and Co. Then MacDonald’s former partner, David Vicinanzo, joined Rilee, and they went ahead with over 1000 lawsuits, petitioning AG Formella (recommended to Sununu by MacDonald) to approve $100 million as a fund.
Vicinanzo, Rilee, Chuck Douglas and Shaheen & Gordon (all the same attorneys, bar Rilee, who profited off the St Paul’s investigation ordered by AG MacDonald and supervised by Associate AG Jane Young) then went shopping for clients off the back of Meehan, the original complainant. RTK emails from the AG’s office reveal that then Associate AG, Jane Young, informed Vicinanzo several times that he had conflicts of interest in the St Paul’s Grand Jury case (representing “most if not all” of the faculty and administrators as well as “E. (last initial redacted). Nothing was done about it, and then Vicinanzo (who also represents the NHCADSV, which lobbied AG MacDonald for the investigation and got a contract out of it) successfully petitioned to keep the Grand Jury findings private after the school and the AG had signed a settlement agreement which stipulated the School waived its right to privacy of the findings.
Meanwhile, David Meehan’s interests have become secondary to other YDC clients of Vicinanzo, Rilee and co whose interests have been met with settlements as high as $10 million. Prosecutorial misconduct by Audriana Mekula is now documented in the first criminal case against YDC employee James Woodlock, causing the State to push the trial back several months. Prosecutorial misconduct is also now documented in a recent YDC criminal trial, causing it to be canceled by Judge William Delker, who sits on the JCC. A “Nolle Prosequi” has been filed for Woodlock’s upcoming trial, which was also to be prosecuted by Audriana Mekula for charges she documented and signed against him. No reason has been given for the trial’s cancellation.
The mess is extremely deep. We also cannot forget that Dianne Martin came with AG MacDonald from that office, and that Jane Young, in representing MacDonald, may also be protecting her own interests by not divulging what she knew, and when she knew it, regarding Dianne Martin and MacDonald. If MacDonald was having an “adulterous affair” with Dianne Martin (as he has claimed Hantz-Marconi was disseminating to other justices), did it start in the AG’s office, and did Jane Young know about it?
MacDonald’s credibility is further damaged by the fact that in September 2021, Dartmouth Magazine reported that he lived “30 miles” outside of Concord with his wife when divorce records show that he had been living apart from her for approximately 2 years at that point and had purchased a property in Hopkinton to be his primary residence between April and June 2021. Where was he registered to vote in 2021? Deering or Hopkinton?
