Gunstock Mountain – It’s Not Nice to Make Sport of Your Customers, Especially When the Contract Says to Not Do That!

After I had submitted my RTK for Tom Day and Cathy White emails, I had found this (which I found to be in the “disturbing” category as it was disparaging Soulfest).  I actually used that word during the Public Session – and I expected that someone, ANYONE, would have asked “Why that word, Skip?”

No one did. Not a single Commissioner appointed for overwatch purposes did.

I didn’t even hear from GM Tom Day about it even with his use of the Critical Mention webcrawler sweeping the Internet for keywords – like “Gunstock Mountain Resort” or “GMR.”

So, after not hearing a “Thanks for letting us know, it will be addressed”, I dashed off an email – to Soulfest directly:

My name is Skip Murphy and I own and manage NH’s largest and most influential political blogsite.

I am investigating a number of issues at Gunstock Mountain Resort (“GMR”) to which a few tipsters have alerted me. As part of that effort, given that GMR are a subdivision of the State of NH (owned by the Belknap County residents), I have been issuing a number of RSA 91-A demands (e.g., Right To Know or RTKs) with which Government agencies must comply.   It has been “interesting” to see what is turning up.

One of those RTKs was for all of the emails, either To or From Tom Day (General Manager and President) and/or Cathy White (Chief Financial Officer).  Since a few of those emails included emails to/from their lawyer (Timothy Tapply, Esq., ttapply@brandtapply.com) responsible for handling the agreement between you and GMR, I thought this email was rather odd in disparaging a well-known summer client like yourself.  Being a 36 year resident of Gilford (and living on the backside of the Mountain), I know that those that come to Soulfest are the types of visitors really like: polite, well behaved, and spend money locally.

I also have a copy of the contract that was attached to one of the “Responsive Records” (e.g., emails) resulting from my request.  Really, they decided to immediately violate Article 9, in which both Parties  shortly after signing it?

I will add, as a long-term resident AND as an Evangelical Christian, I found this both distasteful and derogatory (and with an “anti-Christian odor” to it as one reader described it).

I also have to wonder if the sentiments of these Sr. Staff members have percolated downwards within the entire organization?
