Have you heard the story about the woman from Wilton, New Hampshire? She’s suing the State on air quality grounds after it ended vehicle inspections. Marilyn Jonas. Marilyn Jonas, MS, CCC-SLP. Marilyn Jonas, who donates to Democrat candidates like Joe Biden, Molly Kelly, and Alexis Simpson. Marilyn Jonas, whose Wilton home sits on 6+ acres, has worked for the city of Lowell, Massachusetts, in the Lowell School District, for the past 28 years.
That Marilyn Jonas, the Democrat donor and asthma sufferer who is pissed off because New Hampshire ended the vehicle inspection extortion racket.
Marilyn has sued, but Marilyn has a problem. I think her Lawyer is just taking her money.
There is no law in New Hampshire requiring vehicle inspections (as in emissions inspections), and she can’t sue a law into existence. The democratically elected people’s legislature eliminated it. Being a credentialed lifer in a woke school system may have created the illusion that she can make a court force the state to do something that the State Constitution does not require, and for which there is no statute, but she can’t.
Marilyn has other problems as well.
She could try to leverage the Clean Air Act in her defense, but back in February the EPA rescinded the Endangerment Finding upon which the vehicle emissions mandate stands.
The EPA has rescinded the Endangerment Finding for vehicle emissions. This action, finalized on February 12, 2026, marks a significant rollback of regulations that previously allowed the agency to regulate greenhouse gas emissions from new motor vehicles and engines.
New Hampshire has neither a state nor Federal obligation to perform vehicle emissions testing.
To make any case, I believe she would need to sue the EPA in federal court to reinstate the endangerment finding first, and since it was a bureaucratic exercise (a rule) and not actual law, good luck with that. Her lawyer will, I’m guessing, take her money to try, especially if someone else is paying the legal fees, which they are. Gordon-Darby.
In the lawsuit Jonas filed this week, she’s joined by Gordon-Darby, the company that ran New Hampshire’s testing program. Gordon-Darby has separately sued the state over similar issues.
Gordon Darby appears to have gone fishing for a victim, and they ended up with Jonas on the line. A big ole, credentialed public employee, Dem donor, who works in Massachusetts. But I don’t see how this does anything but waste time and taxpayers’ money.
If air quality is the issue (it’s not), Wilton has better air quality than Lowell, Massachusetts. And if her asthma is the trigger, how do you blame NH for its better non-vehicle emissions inspection air when the vehicle-inspected air she breathes for at least 180 days every year is worse?
As one commenter elsewhere suggested, just wear an N95 mask. It’s not like you don’t know how.
Marilyn would also (likely) need to prove that emissions testing demonstrably improves air quality in the context of her circumstances, which, as we’ve noted previously, won’t be easy either. New Hampshire’s Air quality is as good or better than most of the states that did not require vehicle emissions testing and that the EPA gave waivers to when that was required.
It no longer is.
There’s no endangerment finding. There’s no emissions mandate. There’s no inspection law in New Hampshire.
This is Gordon-Darby, which is based in a state that has no emissions inspection requirement, trying to sue New Hampshire into screwing its drivers so it can make bank.
