The walkback of New Hampshire’s transgender sports ban has achieved escape velocity. News broke late last week of a lawsuit brought by a transgirl who just wanted to play soccer with all the “other girls.” The courts will likely stay the law while the case idles through the so-called justice system, effectively neutering the legislature’s will just in time for school sports to begin.
Saturday morning, after hearing the news of the lawsuit, I wrote, “I’m sure that’s been the plan since it was signed. Someone, somewhere, was looking for someone to sue- grooming them even. And for all we know, Chris Sununu might have been in the shadows hoping for that. My guess is that it’ll happen,” but I must confess to being both surprised and excited about the bill becoming law in the first place. Cautious but optimistic. His Excellency, the Governor, has never been on the side of the Transgender agenda, so I should have been more suspicious.
A few days before the lawsuit was announced, Shannon McGinley wrote,
Governor Sununu’s own Department of Justice – the most liberal DOJ of any Republican state in the country – has consistently lobbied to forcibly integrate biological males into women’s locker rooms, restrooms, and sports. It is no coincidence the Sununu administration disapproved of HB 396 – which offered an actual solution to protect women and girls – and approved of HB 1205.
Although the Republican legislators who supported HB 1205 were well-intentioned, the bill is not long for this world. The new law uses birth certificates as the definition of biological sex – an unwieldy and unworkable concept that has failed both practically and legally around the country. Sununu’s DOJ knows perfectly well that this law will soon be struck down by our liberal federal courts, leaving Sununu holding a fake political trophy and female athletes with no protections.
Sununu’s liberal DOJ is negotiating the terms of surrender on protections for girls in school sports and why not. Chris isn’t running for anything this year, so he pays no political price. He’s been a woke supporter of the cultural left, so the obvious answer is yes – they never intended to allow the girl’s sports law to take effect. But as I wrote in the opening, this has achieved escape velocity. There may still be some political or cultural price to be paid.
Finally, I should add that the headline is a bit misleading. This is precisely how we should have expected Chris Sununu and Company to behave. It is their nature.
