On Special Report this evening, Bret Baier reported that 900 new emails—many pertaining to Bengazi–have been recovered off of Hillary Clinton’s server, and are presently on their way to be reviewed by the House Select Committee on Bengazi. The New York Times also reports the sudden retrieval of the 900 emails, but adds a disturbing qualification to the findings. According to Daniel J. Metcalfe, who served for 26 years as the head of the Justice Department division that supervised government records and privacy issues, Clinton might be in the clear regardless of what is found:

Even if such a review found that Mrs. Clinton had wrongly tried to dispose of what should have been considered government records — a conclusion that could be embarrassing and have political consequences for her — Mr. Metcalfe said there is no formal penalty if the individual involved has left the government.

For the Clinton supporters out there, they may think she is in the clear if something truly damaging is revealed. She IS out of the government, after all. But I think that statement could be read another way: that as long as Clinton *stays out of government*, she is in the clear.

Given the likelihood that something damaging will be uncovered, is Metcalfe giving a veiled bit of advice to Hillary—stay out of government, or else?
