And here’s one more thing: DA’s office agrees to unusual settlement. “The Allegheny County district attorney’s office has agreed to settle a federal lawsuit against it by redistributing a memo explaining that it is not against the law to videotape a police officer in the course of doing his duty. The unusual settlement — which includes no financial terms — came about after a Hill District man was charged with violating state wiretap laws in April 2009.”
With a brand new—and doubtless more competent—New Hampshire state legisature starting in January, it shouldn’t be hard to fix this problem: Simply grant a civil rights cause of action against any police department, and its town or city, and the police officer personally who makes an illegal threat, gives an illegal order, or makes an illegal arrest for videotaping or photographing. Back it up with mandatory statutory damages and an award of attorneys’ fees.
End of problem.
