Some parents wore pink wristbands with two X’s in Sharpie on each, and two years later, even after a First Circuit win, they still can’t wear them to games.
Plaintiffs’ motion to expedite.
Earlier this month, the First Circuit Court of Appeals remanded the case to the lower court to consider whether to grant the plaintiffs’ motion for preliminary injunctive relief. Absent action, the school can continue to violate parents’ First Amendment rights to ‘truly peaceful protest.
It makes you wonder if they should set something on fire to get favorable consideration.
The courts dragged their heels throughout and denied temporary restraining order requests (which is odd considering how popular those are these days). Since the first violation of their rights, several years and numerous spring and fall sports seasons have passed, during which parents’ rights have been affected under threat of additional action by the Bow School District.
Bow is guilty of viewpoint discrimination, and both Bow and the court know this, but as the motion observes, irreparable harm is ongoing.
Bow clearly isn’t going to stop engaging in viewpoint discrimination and the violation of its citizens’ First Amendment Rights until it is forced to, and maybe even then.
That says a lot about the quality of educators and administrators, but sadly, the town is more “woke majority” than average, so the locals are fine with this particular infringement and those responsible, which, by the way, is pure democracy. Mob rule at the expense of natural rights.
If you are voting “for democracy,” this is what it looks like, and if you’re okay with it, at least until the mob finds a reason to disagree with you, you’re an idiot and a threat to liberty and the republic.
