The Contraceptive mandate was not in the bill congress passed that we now call ObamaCare. HHS just made them up.
Obama later had Sibelius create exemptions (without congress) for non-profits on religious grounds that waived any responsibility for the non-profit to pay, and at the same time created rules that would require the insurers to cover those devices of medications without charging those costs to the nonprofit. The Administration made it happen with a phone and a pen.
Obama still has a phone, and a pen.
If he wanted, Obama could write a similar executive order, or his Secretary of Health and Human Services could modify the rules HHS already created for non-profits, to apply to privately owned companies with religious objection to abortifacients.
The question you need to ask every Democrat who is acting outraged at the SCOTUS Hobby Lobby decision should not be why the Supreme Court decided that RFRA prohibits HHS from writing a rule that would punishing Hobby Lobby for only paying for 16 kinds of contraception instead of the 20 the FDA approves (not that they would even know that was what happened). It should be why are Democrats not asking Obama to extend the “rights” HHS already gave to women working in nonprofits to get around RFRA, to women working in private companies?
Every conversation, interview, TV segment or news piece on this subject should include the question: why aren’t Democrats just asking Obama to fix it? It wouldn’t even take him five minutes to do it.
