The Free State of New Hampshire is now a Fully Informed Jury state!

Juries will now be fully informed of their prerogative to "judge the law" as well as the facts and defendant (

The General Court passed it, and now the governor of New Hampshire has signed it as of Friday, June 22, 2012. The law of the state now reads at RSA Sec. 519:23-a as follows:

“519:23-a Right of Accused. In all criminal proceedings the court shall permit the defense to inform the jury of its right to judge the facts and the application of the law in relation to the facts in controversy.”

      I completely agree.  I am very interested to see how the few bad judges in NH (yes, there are so) react to this.  We will just have to see how the defense changes because of this law and how judges react to that.  I wouldn’t be surprised if some judge claims to misunderstand something and a new law, more defined law is passed in 6 years.

  • This is “something” if the defense is permitted to discuss the application of the law vs. doing what is right and just in light of the circumstances and natural law…

    This is one the most significant things I have seen been done in NH, it is fundamental change!
    Did the FSP have a hand in it?

  • The FSP does not “have a hand” in anything in NH. The sole goal of the FSP is get people who agree to the SOI ( to move to New Hampshire. The FSP does not support legislation, candidates, or policy issues.

    Did some people who moved to New Hampshire BECAUSE of the FSP have a hand in this?

    Absolutely. It would not have happened without those movers.
