The politicization started with Marbury v. Madison, when the Court declared that the Constitution says whatever they want it to, and no one challenged them on it. Since then, although the FORMAL amendment process (outlined in Article V) has been used several times, the NORMAL amendment process has been simply that the Court says ‘X is constitutional’ (or unconstitutional), and their saying it MAKES it so, regardless of the degree of conflict with the plain language of the document itself. All of which is to say, Supreme Court Justices do not ‘interpret the Constitution’. They ARE the Constitution. Literally. The Constitution is whatever is in their heads at any given time. And I don’t know of a single elected representative, federal or state, who disputes this. And so when you elect a president, you elect a new Constitution. What could be more politicized than that?
