Must be nice to be above the Law – and openly ignore it

The Rule of LawJust remember, there are consequences to decisions like this – and as Glen Reynolds keeps saying, wait for the Middle Class Anarchy.  So NC Attorney General Roy Cooper (Democrat) has decided that he can ignore a duly legislated and signed law (emphasis mine, reformatted)?

RALEIGH, N.C. (AP) — North Carolina’s attorney general said Tuesday he won’t defend in court a new state law preventing Charlotte and other local governments from approving protections for LGBT people, calling it discriminatory and a “national embarrassment.”  Democrat Roy Cooper made the announcement during a news conference a day after gay rights advocates sued to overturn the law approved last week and signed by Republican Gov. Pat McCrory.

The federal lawsuit lists Cooper among the defendants because of his official position as the state’s top lawyer, but he has said he wants it repealed.  “Not only is this new law a national embarrassment, it will set North Carolina’s economy back if we don’t’ repeal it,” Cooper said. “We know that businesses here and all over the country have taken a strong stance in opposition to this law.”

Well, NC has a law legislated by two houses run by Republicans and and a Republican Governor – ALL of them elected by citizens of your state.  And yet, YOU get to decide all by your lonesome to ignore it?  GET OVER YOURSELF!  If you can’t follow the law, if you can’t do what you were duly elected to do, resign.  After all “businesses here and all over the country” didn’t vote in your Legislators and certainly didn’t vote for YOU.  Did you campaign on the promise “if a law is passed I don’t like, I can ignore it”?

Oh, right -politics trumps The Rule of Law?  Your “end” justifies your means?

Cooper’s announcement raises the stakes for the November governor’s race, in which Cooper is challenging McCrory. National Democrats consider it their best opportunity to pick up a governor’s mansion where a Republican currently resides. The campaigns of McCrory and Cooper already have raised more than $13 million combined and the Republican Governors Association has reserved $4 million in ad time for the fall.

The Republican-led legislature and McCrory approved the law because they say Charlotte went too far with a local ordinance allowing transgender people to use the restroom aligned with their gender identity. They have focused on the threat – used by opponents of Houston’s LGBT ordinance last year while defeating it in a referendum – that sexual predators could use these kinds of rules as a pretense to enter women’s bathrooms and locker rooms. Gay rights groups have called these and other arguments bogus.

Cooper’s decision continues a yearslong tussle between him and Republican leaders in state government, who say they don’t trust the attorney general to robustly defend state laws challenged in court.

Hey, remember that US Attorney General Eric Holder famously declared that because HE didn’t think a law was Constitutional so he didn’t have to defend DOMA.  He got to pick and choose to what Law to defend – and which one not to.

Middle Class Anarchy – right now we get to see the High, Mighty, and Politically Connected decide what Laws they get to obey – and not.  They do so for their own benefit.  So does the criminal class.  Stuck in the middle is the Middle Class.  What these Elites fail to realize is that their example and their behavior will only be tolerated for just so long before the rest of us decide “hey, if they don’t, we don’t have to either”.  As some have called it, the settling in of Irish Democracy:

Preference Cascade – how long will it take for that Lawlessness of Leaders finally takes root lower down?  And there are more of us than of them – and remember, those that are tasked to enforce the law at the top are already showing disregard for it.  And those responsible for the street enforcement?  Yeah, part of that same Middle Class.  After all, look at what the Border folks have already been told to do – do NOT arrest illegals crossing the border but just let them go OR lose YOUR job.
