Sorry Ian Underwood – SCOTUS just declared that words no longer have meanings

ScotusCare: The Judge has a few choice words. Ambiguous.  Steve put up one of Supreme Court Justice Scalia’s words of dissent from today’s King vs Burwell decision – I agree.  Former judge Napolitano, a strict Constitutionalist who, due to his attitude and oratory is a favorite speaker on the conservative trail (I have heard him twice in person – he can hold a crowd and get them on their feet!) also had a few choice words.  I was glancing at SCOTUSblog when it was announced real time and then happened to catch the judge on Fox:

My immediate reaction is that the chief justice has yet again resorted to a nearly unheard of construction in order to save the statute,”

“Last time around when the government said it was not a tax and the challengers said it was not a tax, the chief justice ruled it was a tax and that saved it. This time around he took the plain meaning of ordinary words, ‘established by the states,’ and somehow held that they were ambiguous, and that he could — and that that the majority could — correct the ambiguity according to what they thought the drafters meant.  The court is now in the business of saving a statute in order to save its reputation

So, the IRS decided to interpret Obamacare counter to what MIT Professor Jonathan Gruber said was its intent (guilt the various Status into implementing Exchanges in order to be eligible for tax credits; here and here for starters) and the Supreme Court just covered from them.

I’ll put up another post on this later but it seems that there is no reality anymore – anything is “the truth” and when that drives both the culture, the Law, and Government (“It is what I say it is”), we are going to end up in a world of hurt.  When nothing has an established meaning, when plain language is no longer what has been commonly agreed upon, and the basics worldviews are vastly different, there is no commonality anymore.  And without some level of commonality, there can be no America.

For without “words have meanings”, there is no Rule of Law – we will have regressed backward to the Rule of the Strong Man.  Which seems to be just dandy to the Left, for that is their end point – and they are working their damnedness to be that Strong Man.

It is good to be the King.
