Manchester’s Dr. Nicholas Marshall Found Not Guilty – Cleared of All Charges

medicade thumbnailAt the beginning of this year I wrote an article with regard to Medicaid fraud and New Hampshire’s pursuit of expanding it; Medicaid and fraud go hand in hand.  (Government programs are built for fraud.) In the course of that article I cited recent charges by the NH AG against a Dr. Nicholas Marshall, an Orthodontist in Manchester.  Marshall was charged with 45 counts of Medicaid fraud.  Dr. Marshall has been found innocent of all charges.

In a trial that might have significant consequences for Medicaid in New Hampshire, a Manchester orthodontist was cleared of 45 felony counts of Medicaid fraud by a Concord jury last week.

In my original remarks I suggested that this might be an act of theater by the NH AG”s office.  I also hinted that Marshall was probably guilty of something–because the system continues to be gamed to make it nearly impossible to be innocent.  It is just a matter of if and when you are charged, why, and by whom.  Dr. Marshall was found not guilty, but the system is still messed up, and the NH AG’s office is still suspect.

We’ve heard nothing about Lorin C. Schneider, Jr., of Carver, Massachusetts since the November 22nd announcement that he had been charged with wrongful voting.  Someone who never popped despite dozens of activists digging through voter rolls in search of double registered out of state voters.  A guy who didn’t do anything that different from the score or more of activists we uncovered whom the AG either validated out of hand or ignored altogether.

Now we’ve got Dr. Marshall, Frog marched before the media as evidence that while Fraud happens, the AG’s office is on the case, though he is not sure himself what he did wrong and the AG has not bothered to tell his lawyer yet.  Law is complicated.  That may take some time.

Dr. Marshall appears interested in doing the right thing by using his skills and the available programs to help the community, and is simply trying to navigate the labyrinth erected by the government.   So why did he run afoul of the AG’s office.  From the same UL linked article…

Under New Hampshire criminal law, a theft is a felony only if the stolen property is worth $1,000 or more. But state Medicaid law makes any fraud involving Medicaid a felony, no matter the amount.

The case was the first-ever criminal prosecution for Medicaid fraud in New Hampshire, said Karin Eckel, director of the Medicaid Fraud Control Unit, which is part of the Attorney General’s Office.

She would not respond to Moir’s statement, nor discuss reasons for bringing multiple charges against Marshall.

The NH AG’s office isn’t off the hook.  Asst AG’s housing vote stealers, selective prosecution, hazy interpretations of clearly defined legal terms like domicile and residence…and they were pushing hard to get Marshall to cave and admit guilt.

Kudos to him for fighting for his day in court.  Far too often people cave to the pressure and let the lawyers in government win.

As for the government’s lawyers, we’ve heard a few more things that will coming to light on a different topic, that will once more show them to be tied to the political machine, and not the law or the rights of the people they are supposed to protect.  State tuned.
