Another massive rebuke delivered by a unanimous supreme court. Obama can’t decide for himself (for the purpose of making recess appointments) if, and when, the US Senate is ‘In Session.’ The Senate decides that (as does the House). Not Obama. /slap on wrist.
The Supreme Court dropped a huge bomb on the Obama administration, unanimously rebuking the President for arrogating to himself the determination of when Congress is in session for the purpose of making recess appointments.
As George Mason University law professor Ilya Somin told the Washington Times last year, “When the administration loses significant cases in unanimous decisions and cannot even hold the votes of its own appointees . . . it is an indication that they adopted such an extreme position on the scope of federal power that even generally sympathetic judges could not even support it.”
(Obama has lost 13 cases to the Supreme Court where is his administration took a position and the Justices rebuked it unanimously.)
