What difference does it make?

You’ve already read about SB 244 sponsored by Senator David Watters.  Senator Watters asks physicians to break their oath of confidentiality and snitch on people needing mental health counseling and treatment.  Senator Watters doesn’t trust people to self-declare on the ATF Form 4473. Nooooo, he wants to create a Pre-Crime Division that could brand any and all who have sought mental health treatment into automatic criminals and felons and deprive them of their 2nd Amendment rights with only Senator Watters’ interpretation of what the 5th Amendment means.

Say you are one of the 7-8% of the U.S. population who will suffer from Post Traumatic Street Disorder at some point in their lives – Senator Watters says “No guns for you!”.

Say you are a someone who recently lost a spouse and you sought counseling?  Senator Watters says “No guns for you!’

What if your child had been treated  his or her entire childhood – without his or her permission – for Attention Deficit Disorder?  Senator Watters says “No guns for you!”

But but but…” you say, the bill only “… requires the name of a person who has been adjudicated as not mentally competent to be reported to the National Instant Criminal Background Check System for the purpose of conducting a background check to determine eligibility to possess a firearm…”  What if that person never intends to purchase a firearm?  What difference does it?  Senator Watters’ bill will automatically make that person a criminal by requiring his or her name to be reported to the NICS!

But but but…”, you say, the bills allows persons who were so declared criminals the chance to have their name removed:

159-E:2 Petition For Removal From the NICS Index.

 I. A person whose name and mental health information has been submitted to the NICS Index pursuant to RSA 159-E:1 and is thereby prohibited from purchasing a firearm may file a petition in the court that issued the commitment or guardianship order to have his or her name and mental health information removed from the NICS Index after:

(a) Termination of the guardianship; or

(b) The passage of 3 years since the expiration of the commitment order.

So Senator Watters makes you a criminal for free and you get the privilege of paying to prove you are not.
