Getting it Right on the “Nuclear Option” – Part 2

This is about Reid helping Obama add additional liberal judges to the DC Circuit court, guaranteeing a policy advantage in perpetuity.

Certainly that forms a bulwark that will protect Obama’s legislative agenda – any lower court appeals has to run through it.  The Supreme Court gets a whole lot harder to get to and I believe that will bottle up a lot of suits that could be overturned.  Thus, “fundamentally transforming” the judicial system to skew, not just Liberal but as far Left as possible has become much easier.  How best to continue onward to a post-Constitutional Republic than by having judges making rules that will be making us Constitutionalists’s eyes squirt blood when we compare those rulings against traditional Constitutional values.  For example, what Obama’s pronouncement that the Senate was not in session simply on his say so in terms of NLRB appointments?  And then put his Union buddies on the NLRB and crowded out the opposition – he packed that Administrative entity.

And that is the greater and much more serious problem.   I don’t care if you are Right or Left as long as you respect the Constitution – in doing what he did with the NLRB and in other situations, Obama and his “We can’t wait” [for Congress] campaign shows that he doesn’t regardless of what comes out of his mouth.  He knows that the “filibuster” still exists – the Republican majority in the US House.  So, he will “be the water” and flow around it – just look at the changes he is making in his namesake law: a banana republic dictator like Chavez (and now Madura) instead of a George Washington.  He now will have a FAR more easier time to simply put like minded folks, those that believe that Individuals should be subservient to the State, into positions that will create regulations and rulings that will affect us just as legally as if they were legislated.  Indeed, just think of what the IPAB (“the Death Panel”) appointees will do now in the area of healthcare that it will be FAR easier to pass them  through the “Enlightened” consent process of the Senate?  The Senate being a check on the Executive Branch’s power?  Nay, merely the greaser of the skids.  Less and less will we be able to just believe “Aw, they all believe in the Constitution, right?” and face the fact that to these Progressives, the Constitution is an impediment, and worse, are doing what they can to move it to the dustbin of history as they move us to the next phase of descent: Majority Democracy – The Rule of the Mob versus the rule of law.

Democrats AND REPUBLICANS are responsible for the Leviathan size of our Federal Government’s Executive Branch; it now has sufficient powers unto itself that Obama can now rule as a Unitary President.  He can, and is acting as, the Executive, Legislative, and Judicial branches all wrapped up into one Supreme entity – the EXACT situation that our Founders were trying to keep from happening with all of the checks and balances.  Both Parties have their Progressive sides which seeing this transformation into the Administrative state.

The Nuclear Option of eliminating has now moved us closer to being a mere European parliamentary system.  One by one, the checks and balances so carefully crafted by the Founders are being removed one by one.  They were scared of creating a democracy which they knew would finally result in mob rule – so they deliberately made it harder to pass new legislation and curb the excesses of power by any one faction of Government.  Each one, starting with the passing of the 17th Amendment (allowing for direct election of Senators to represent the States) was the first.  Allowing the Fed to hoover money via income taxes was another.  Creating completely independent entities (yes, the Fed is one) and removed from Congressional oversite are others.

Now, the entity that was to be the “deliberative chamber” is what?  Just the House with fewer members and longer terms.  And with Obama, more and more, will be happy to issue diktats rather than going the legislative route, what check will there be on him?  Reid has now declared the Senate to be his laptop and the entity that the Founders wanted to be the check on the government as a whole, the Press, has simply joined his campaign team.
