Forster’s Christmas Tree Farm v. Town of Henniker Goes to Court

Forsters christmas tree farm Henniker NHWe’ve written a few posts about the Henniker, New Hampshire ZBA going after Forster’s Christmas Tree Farm (here, here, here, here, and here).  Well, we’re back.

Forster’s has taken their fight for RSA 31:24a, which clearly provides for the activity the Henniker Board denied, to Merrimack County Court.  It is a fight for all of our property rights against local boards, committees, and seletman who would ignore the law for their own purpose, regardless of what those purposes might be.  There is a hearing today at 1pm.  Anyone that can be there for moral support is encouraged to attend.

Here is a snippet of an email Steve Forster sent out to those who have been supporting his defense against the town of Henniker.

My fight is small to whats going on these days in our country! But we must pick our fights and the fires we put out. I am a firm believer that all our problem have started from the lowest levels of our governments. Our towns! Then our cites, states and then country. I cannot fight big government as a single entity, however, I can fight our lower levels of government and feel as if I had accomplished something. I can put out the small fire, which will lead to a huge fire, if I don’t.

My small fight, however, can effect, many people that believe that their property rights and land ownership is protected. Their right to live on their land as they choose, to feel free to use their land. Laws are in place that currently control us and limit us to our use of our land or properties. We pay taxes on our properties and we think we own our properties, the fact is, you will never own your property!

September 3rd, Merrimack County Court at 1:00 pm, My fight continues! Tomorrow could decide on wether a law in place for property rights is valid or just written on paper with intent of no meaning at all. I am defending a State RSA, NHRSA 21:34a, A state law that gives farmers a alternate venue to use their farms to generate additional revenue from their farms. The spirit of the law  is to, at least it seems, to protect the farms and keep the agriculture community a valuable asset that generates cash flow for the farmer, the state and saves the farm.
