GrokTALK! today – When is a loaded pistol, er loaded?

Today on GrokTALK!, Evan Nappen (a nationally recognized Second Amendment barrister) was our guest for the second half of the show and we talked about a case called State vs Dore.  Here, a man had an unloaded pistol in his glovebox (no round in the chamber, no magazine in the magazine well) with  fully loaded magazine next to to.   RSA 159:4 play a role here:

No person shall carry a loaded pistol or revolver in any vehicle or concealed upon his person, except in his dwelling, house or place of business, without a valid license…. A loaded pistol or revolver shall include any pistol or revolver with a magazine, cylinder, chamber or clip in which there are loaded cartridges.

Well, the State of NH (and the law enforcement directly involved in the case) wanted to redefine, IMHO,  both words “with” and “loaded”, contrary to what most people would think in a plain reading of the RSA (er, NH Law).  Surfing around earlier a bit today, I found that one of the more popular legal blogs, Volokh Conspiracy, mentioned this case and came up with “I like it.” for the treatment that the NH Supreme Court gave to it.  GRTWT.
