How come Shea-Porter can use the official State Seal?

How come she can use it and NH Insider cannot?  What is so special about a Democrat politician's website?

Oh yeah, she's a Democrat politician in a Democrat State....and NH Insider is not a Democrat site.

(SMACK) D'uh!

The Story:

Will the NH Sec. of State and NH AG Take Action?

NHInsider.com was told, after going back and forth a few times that it is against the law to use the image of the State Seal on our webpage. When we objected the State Attorney General issued a cease and desist order or something to the effect that they were going to prosceute [sic] us for using the seal. We took it off our front page.

Now congresswoman Carol Shea-Porter has a website

This website is affiliated with Rep Shea-Porter's campaign for another term in the US house of Representatives. That has no real connection to the State of NH business yet she has the State Seal adoring her front page.

Will she be threatened with legal action or will she be allowed to keep it up on her website?

I'll run this story on my blog with pleasure. I am not Carol's biggest fan. I did go check out her sight. The State seal is still there, but what caught my attention was the quotes she has flashing accross the page header. There were a handful but this one made me laugh so hard I almost hurt myself. "We must not let our rulers load us with perpetual debt" Thomas Jefferson I don't believe I need to explain why I find that so amusing. Live Free or Die! http://newhampshire.wordpress.com/
NH laws, RSA 3:9-a govern the use of the state seal. I'm not a lawyer, so I could be wrong on "understanding", but it sounds like all one has to do is ask the secretary of state for permission. But I'm wondering if there may be an "implied right" to use it if you are a NH resident. To me, displaying the state seal on a web page of a NH resident sounds like a Fair Use type of thing. Almost as if they say "you can't display the NH state flag on your house". But, I'm not a lawyer, so I could be wrong.
